1723 113 And the said Anne Nutter admrx as afd by George Dashiell her attorney Comes and defends the force and Injury when &c and prays Leave to Imparle hereunto untill the Next Court and he hath it and the Same day is given to the plft also Att which said Next Court to witt the twentieth day of august ann Dom One thousand seven hundred and twenty three Comes againe the said Richard Bennett by his attorney afd and prays that the said Anne Nutter adm.rx as afd to his declaration in the plea afd may answer but the said Anne Nutter altho Solemnly Called Comes not But makes default whereby the said plft remains against the said deft thereof undefended &c Butt because it is not Known what damages the said Richard Bennett hath sustained by Occasion of the premisses afd Whereupon the Justices here at the prayer of the afd Richard and by theassent of the afd Anne ^according to act of assembly^ doe assess the damages of the said Richard besids his Costs and Charges by Occasion of the premisses afd to four pounds twelve shillings and four pence halfe penny Curr.t money &c Therefore it is Considered by the Justices here the twentieth day of August ann Dom One thousand seven hundred and twenty three afd that the said Richard Bennett recover against the said Ann Nutter admrx of the same Mathew Nutter as well the sume of four pounds twelve shillings and four pence halfe penny (262) Curr.t money Certain damages afd in form afd assesed as also the sume of Two hundred Sixty Two pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his suite in this Behalfe Laid Out and Expended and To be Levied of the goods and Chattles which were of the said Mathew Nutter att the time of his death in the Hands of Anne Nutter admrx as afd remaining to be administred if so much thereof in her hands she hath &c and if so much thereof in her hands she hath not &c then the Costs of Suite afd to be Levied of the proper good and Chattles of the said Anne Nutter & ye Deft in mercy &c
County Court of Somersett to be held at dividing Creek the third tuesday of June then next to answer unto John Williamson of a plea of trespass upon the Case &c and that thereof he should not faile &c Att which said nex third tuesday of June to witt the Eighteenth day of the same month ann Dom One thousand seven hundred and twenty three Being the day of the return of the said Writt Cometh the said John Williamson by William Tazewell his attorney and the sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed in these words following vizt Cepi Corpus P Jos: MccClester Sherr And the said William Mathews by Francis allen his attorney Comes and saving to himself all manner of advantages and Exceptions to the witt afd prays Leave to Imparle hereunto untill the & Next Court and he hath it and the same days is given to the Plft also Att which said next Court to witt the twentieth day of august ann Dom One thousand seven hundred & and twenty three Comes again as well the said plft as the said deft by their attorneys afd and the said deft by his said attorney defends the force and Injury when &c and prays the recoring of his the said (John's) |
