here the same day and year Last mentioned that the said Thomas Timmons Recover against the said John Layton as well
the sum of five hundred pounds of tobacco and fifteen Bushells of Indian Corn Certain damages afd in form afd Confesed
(240)   as also the sume of Two hundred & forty                                                                     pounds of tobacco by the
Court here adjudged unto him for his Costs and Charges by him about his Suite in this Behalfe Laid Out & Expended and the
deft in Mercy &c

Sommersett County fs.t  Anne Nutter of Nanticoake hundred in the County of Sommersett widdow
admrx of all and singular the goods Chattles rights and Creditts of Mathew Nutter dec.d was
attached to answer unto Richard Bennett Esqr of a plea of trespass upon the Case &c
And whereupon the said Richard by Francis allen his attorney Complaines that whereas
                   the said Mathew in his Life time to witt on the twelfth day of July ann Dom One thousand seven hundred and
fourteen at the hundred and County afd within the Jurisdiction of this Court was Indebted unto the said Richard in forty
pounds Eight shillings and three pence halfe penny Curr.t money of maryland as by acct hereunto annexed may in Court
appear and being so thereof Indebted the said Mathew in Consideration thereof the day and year afd at the place afd
within the Jurisdiction afd in his Life time upon himselfe did assume and to the said Richard then and there did faithfully
promise that he the said Mathew the said forty pounds Eight shillings and three pence halfe penny to the said Richard
when he should be afterwards thereunto requested he would well and faithfully pay and Content and altho' the said Mathew
in his Life time did satisfie and pay unto the said Richard thirty two pounds seventeen shillings and two pence Pcell
of the afd forty pounds Eight shillings and three pence halfe penny yett as to seven pounds Eleven shillings and One
penny halfe penny residue thereof the said Mathew in his Life time nor the afd Anne to whom administracon of all &
singular the goods Chattles rights and Creditts of the said Mathew after the death of the said Mathew in due form of Law was
Committed the promise and assumption afd of the afd Mathew in form afd made Little regarding but plotting and fraudulently
intending him the said Richard in that part Craftilly and Subtilly to deceive and defraud the said seven pound Eleven shill.s
and One penny halfe penny or any part thereof to the said Richard have not paid or Contented nor Either of them hath paid
or Contented altho' the same to doe the said Mathew in his Life tome witt on the twelfth day of July ann Dom One thousand
seven hundred and fifteen and the said Anne after the decease of the said Mathew to witt on the first day of November ann
Dom:  One thousand seven hundred seven hundred and twenty two at the hundred and County afd within the Jurisdiction afd
by the said richard they were thereunto requested but the same unto him to pay have refused and the said Anne the same
to the said Richard to pay still doth refuse and deny whereupon the said Richard saith he is worse and hath damage
to the value of fifteen pounds money afd and thereupon he Brings his suite &c    F Allen P Qrte pledgs deft Jno Do R Roe
