106 Whereupon the said William Whitting^ton^ by his attorney afd prays that the afd horse, mare, Plank, hoggs, Cart and Wheles and two yearling Bulls all of the value of four pounds five shillings so as afd attached as the Goods and Chattles of the afd robert Pitts may be Condemned for the Use of the said William Whittington towards satisfying his debt of six pounds one shilling and seven pence and all Costs accrued &c Therefore it is Considered by the Justices here the twentieth day of august ann Dom one thousand seven hundred and twenty three that the afd horses, mare, Plank, hoggs, Cart and Wheles & two Bulls of the value of four pounds five shillings ^afd^ be Condemned in the hands of Joseph Macclester high sherr of the County afd as of the rights and Creditts of the said robert Pitts and that his Lordships Writt of vendetione Exponas Issue to the said sherr to sell and dispose of the same Goods and Chattles afd attached to satisfie unto the said William Whittington his debt and Costs afd &c
Lady widdow and Executrix of the Last will and testament of the right honourable Charles Lord Baron of Baltemore lately dec.d of a plea that they render unto her four thousand Eight hundred pounds of good sound merchantable Leafe tobacco and Cask which from her they unjustly detain &c And whereupon the said Margarett Lady Baltemore by Francis Allen her attorney Complains that whereas the said John in his Lifetime to witt the twenty Eighth day of September ann Dom One thousand six hundred and Ninety four at Somersett County afd within the Jurisdiction of this Court by his Certain Writeing Obligatory which the said Margarett Lady Baltemore with the seal of the said John in his Life time time signed here into Court Brings the date whereof is the same day and year did acknowledge himselfe to be Bound unto the said right honourable Charles Lord Baron of Baltemore in his Lifetime in the afd four thousand Eight hundred pounds of good sound merchantable Leafe tobacco and Caske to be paid unto the said Lord Baron of Baltemore when he should be thereunto required Nevertheless the afd John in his Lifetime nor the afd rachell Between them Exrx as afd whilest she was sole nor the afd Nicholas and Rachell after Espousalls Between them the said Nicholas and Rachel Celebrated tho' often required the afd four thousand Eight hundred pounds of good sound merchantable Leafe tobacco and Caske to the afd Lord Baron of Baltemore in his Lifetime or ^to^ the afd Margarett Lady Baltemore Exrx as afd after the death of the said Lord Baron of Baltemore have not rendered ^but^ the same to her to render have denyed and unjustly detain &c to the retarding her in the Execution of the Last will and testament afd whereupon she saith she is worse and hath damage to the value of five thousand pounds of tobacco and thereupon she brings suite &c and Brings into Court here the Letters testamentary afd of the afd Lord Baron of Baltemore the testator by which it plainly appears to the Court here her the afd Margarett to be the Exrx of the testament of the said Lord Baron of Baltemore &c the testator & thereupon to have admrn &c Allen P Qrte Plegs Deft Jno Doe R Roe (and) |
