107 And the afd ^said^ Nicholas Evans and Rachel his wife Ex.rx of the afd John Huet by George Dasheill their attorney Come and defend the force and Injury when &c and pray Leave to Imparle hereunto untill the next Court and they have it and the same day is given to the plft also Att which said next Court to witt the twentieth day of November Ann Dom One thousand seven hundred and twenty three two Comes again as well the said Margarett Lady Baltemore Exrx as afd by her attorney afd as the said Nicholas Evans and Rachel his wife Exrx as afd by their attorney afd and the said Nicholas Evans and Rachel his wife by their said attorney pray further Leave to Imparle hereunto untill the next Court and they have it and the same day is given to the plft also Att which said next Court to witt the Ninteenth day of march ann Dom One thousand Seven hundred and twenty two Comes again as well the said Margarett Lady Baltemore Exrx as afd as by her attorney afd as the said Nicholas Evans and Rachel his wife Exrx as afd by their attorney afd and the said Nicholas Evans and Rachel his wife by their said attorney pray further Leave to Imparle hereunto untill the Next court and they have it and the same day is Given to the plft also Att which said next Court to witt the Eighteenth day of June ann Dom One thousand seven hundred and twenty three Comes again the said Margarett Lady Baltemore Ex.rx as afd by her attorney afd and Inform'd his Lordships Justices here that since the Last Continuance of the plea afd to witt the Ninteenth day of march One thousand seven hundred and twenty two afd from which day the plaint afd was Continued here untill this day to witt the Eighteenth day of June One thousand seven hundred and twenty three and Before this day to witt on the Ninteenth day of may now last past the afd Nicholas Evans at Somersett County within the Jurisdiction of this Court dyed and that the Cause of action of her the said Margarett Lady Baltemore Ex.rx as afd did survive to her the said Margarett Lady Baltemore against the afd Rachel Evans (wife of the afd Nicholas Evans dec.d Exrx of the afd John Huett) according to the form of the statute in such Case made and Provided Whereupon the said Margarett Lady Baltemore Exrx as afd by her attorney afd prays that the afd rachel Evans Ex.rx as afd to her declaration in the plea afd may answer thereupon at the prayer of the said rachel Evans Exrx as afd day is Given to the said rachell here untill next Court to answer the afd Margarett Lady Baltemore in the plea afd and the same day is given to the plft also Att which said next Court to witt the twentieth day of august ann Dom One thousand Seven hundred and twenty three Comes again as well the said Margarett Lady Baltemore Exrx as afd by her attorney afd as the said Rachel Evans Exrx as afd by ^George Dasheill^ her attorney afd and the said Rachell by her ^said^ attorney defends the force & Injury when &c and says that the afd Lady Baltemore her action afd against her to have Ought not because she says that the debt and writeing Obligatory afd hath been above twelve years standing at the time of the Commenceing the action afd of the afd Lady Baltemore against the afd rachell and this she is ready to verifie whereof she prays Judgm.t whether the afd Lady Baltemore Ought her action afd against her ye said rachell to have &c G Dasheill P Deft (And) |
