       Sherriff to ^sell dispose^ expose of the same fifteen sheep Cow & yearling and Cow and Calfe of the value afd towards
       satisfying unto the said robert Martin the sume of two thousand four hundred pds of tobacco afd &c

memorandum the plft by francis allen his attorney Sued Out his Lordships writt of

attachment against the deft the tenor whereof followeth in these words vizt
                         Somersett County fs Charles absolute Lord and proprietarie of the provinces of maryland and
    avalon Lord Baron of Baltemore &c  To the Sherr of Somersett County Greeting Wee Command you that you
    attach any the goods Chattles Rights or Creditts of Robert Pitts of Coventry Parish in Somersett County
    Planter al.s dictus Robert Pitts of Somersett County in the province of Maryland if they shall be found in
    your Bailywick to the value of six pounds One shilling and seven pence Curr.t money of this province
    and Eight hundred pounds of tobacco and when you have the same attached or any part thereof the same
    in your Custody Safe Keep so that you have the same Before the Justices of Our County Court to be held at
    Dividing Creek in Somersett County afd the third tuesday of august next then and there to be Condemned according
    to act of assembly to and for the use of a Certain William Whittington ^with the said robert Pitts by himselfe or his attorney shall appear and answer unto ye said W.m Whittington^ in a plea that he render unto him six
    pounds One Shilling and Seven pence Curr.t money of this province &c according to Law and that by good &
    Lawfull men of your Bailywick you make Known unto the person or persons in Whose hands you make
    the same attachment that he she or they be and appear before the Justices of Our Said Court to be held as
    afd to Shew Cause if any he she or they have why the same Goods Chattles rights or Creditts so attached in his
    her or their hands Ought not to be Condemned and Execution thereof had and made according to the
    form of the act of assembly in that Case made and provided if to him her or them it shall seem mete and
    how you shall Execute this Writt that you make Known unto the Justices of Our Said Court at the same
    day and place afd and have you then and there this Writt Wittness Charles Ballard Gent Cheife Justice of
    Our Said Court the Ninteenth day of June in the Eighth Year of Our Dominion &c ann Dom 10723

          Att which said third tuesday of august to witt the twentieth day of the same month ann Dom one
    thousand seven hundred and twenty three Being the day of the return of the said Writt Cometh the said
    William Whittington by his attorney afd and the Sherr of Somersett County to whom the foregoeing Writt
    was directed  Likewise Cometh and maketh return thereof to the Court here Endorsed in these words
    following viz.t  By vertue of the Within Writt to me directed to the Justices within Mentioned I Certefie
    that I have attached as the goods and Chattles of the Within Named robert Pitts to the value of four
    pounds five shillings Curr.t money as appears by a Certain Schedule thereof taken and hereto annext
    towards satisfying unto the Within Named William Whittington his debt and Costs recovered against him
    the afd robert Pitts as by the Within Writt I am Commanded so answers      Jos: MccClester Sherr

    an acco.t of sundry goods attached as the Effects of of the said Robert Pitts   1 small horse 1..5 - 1 yearling
    D.o 12/  one yearling Mare 5/  260 foot of Pine Plank 10/  5 head of hogg 12/  one old Cart
