105 absolute Lord and proprietarie of the province of Maryland and avalon Lord Baron of Baltemore &c To the Sherr of Somersett County Greeting Wee Command you that you attach any the goods Chattles rights or Creditts of Robert Pits late of all hollows Parish in Somersett County planter if they shall be found in your Bailiwick to the value of two thousand four hundred pounds of tobacco and when you have the same so attached or any part thereof the same in your Custody safe Keep so that you have the same Before the Justices of Our County Court to be held at Dividing Creek in Somersett County afd the third tuesday of august next then and there to be Condemned according to act of assembly to and for the use of a Certain Robert Martin unless the said Robert Pitts by himself or his attorney shall appear and answer unto the said Robert Martin in a plea of trespass upon the Case &c according to Law and that by good and Lawfull men of your Bailiwick you make Known unto the person or persons in whose hands you make the same attachment that he she or they be and appear before the Justices of Our Said Court to be held as afd to shew Cause if any he she or they have why the same goods Chattles Rights or Credits so attached in his her or their hands Ought not to be Condemned and Execution thereof had and made according to the form of the act of assembly in that Case made and provided if to him her or them it shall seem mete and how you shall Execute this writt that you make Known unto the Justices of Our Said Court at the same day & Place afd and have then and there this Writt Witness Charles Ballard Gent Chief Justice of Our Said Court the Ninteenth day of June in the Eight Year of Our dominion &c ann Dom 1723 (F Allen) Thomas Hayward Clk Att which said third tuesday of August to witt the twentieth day of the same month ann Dom One thousand seven hundred and twenty three Being the day of the return of the said Writt Cometh the said Robert Martin by his attorney afd and the Sherr of Somersett County to whom the foregoeing Writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed in these words following vizt By vertue of the Within Writt to me directed to the Justices within Mentioned I Certefie that I have attached as the Goods and Chattles rights or Creditts of the Within Names Robert Pitts to the value of One thousand and thirty pounds of tobacco (as appears by a Certaine shedule thereof taken and hereto annext) towards satisfying unto the Within Named robert Martin his damage and Costs recovered against him the afd Robert Pitts as by the Within Writt I am Commanded so answers Jos: MccClester Sherr an account of sundry goods and Chattles attaches as the Effects of Robert Pitts viz.t
Whereupon the said Robert Martin by his attorney afd prays that the afd fifteen sheep One Cow & Calfe & Cowe and Yearling of the value of One thousand and thirty pounds of tobacco so as afd attached as of the rights Goods and Chattles of the said robert Pitts may be Condemned in the hands of the said sherr towards satisfying unto the said robert Martin the sume of two thousand four hundred pounds of tobacco afd Therefore it is Considered by the Justices here the twentieth day of August ann Dom One thousand seven hundred and twenty three that the afd fifteen sheep Cow & yearling & Cow and Calfe of the value of one thousand and thirty pounds of tob.o afd attached as the Goods and Chattles of the said robert Pitts be Condemned in the hands of Joseph MccClester ye said sherr; and that his Lordships Writt of venditione Exponas Issue to the said sher |
