105 on the first day of June in the Year afd and often afterwards at the Parish and County afd within the Jurisdiction afd he was thereunto requested but the same unto him to pay or in anywise to Content hath refused and still doth refuse and deny Whereupon the said Benjamin saith he is worse and hath damage to the value of two thousand two hundred ^and fifty^ pounds of tobacco and thereupon he Brings Suite &c Allen P Qrte Pledg def Jn Doe R Roe
Att which said third tuesday of august to witt the twentieth day of the same month ann Dom One thousand seven hundred and twenty three Being the day of the return of the said Writt Cometh the said Benjamin Wailes by his attorney afd and the Sherr of Somersett County to whom the foregoeing Writt Was directed Likewise Cometh and maketh return thereof to the Court here Endorsed in these words following viz.t Cepi Corpus P Jos: MccClester Sherr Whereupon the said Cornelius Woodkerson being Called appears and thereupon the said Cornelius Woodkerson at the prayer of the plft by his attorney afd is adjudged to give Speciall Bail to the action afd Thereupon a Certain William Young of Somersett County Planter ^present here in Court in his proper person^ undertakes for the said Cornelius Woodkerson that in Case the said Benjamin Wailes shall recover Judgm.t in the plea afd against the said Cornelius Woodkerson or that the said Cornelius Woodkerson shall be therein Convict that then he the said Cornelius Woodkerson shall pay the Condemnation of the Court thereupon or render his Body to the Custody of the Sherr of Somersett County in satisfaction thereof or that he the said William Young will doe it for him &c Whereupon the said Cornelius Woodkerson in his Own proper person Comes and defends the force and Injury when &c and saith that he Cannot Gainsay the plft his action afd so as afd against him Brought nor Can he say But that the said plft Ought to recover his damages by Occasion of ye Premises afd to the sume of Eleven hundred and twenty five pounds of tobacco and Costs of Suite ^against him^ which the said plft does not gainsay &c Therefore it is Considered by the Justices here the twentieth day of August ann Dom One thousand seven hundred and twenty three afd that the said Benjamin Wailes recover against the said Cornelius Woodkerson as well the sume of Eleven hundred and twenty five pounds of tobacco Certain his (295) damages afd in form afd Confessed as also the sume of Two hundred and Ninty five pounds of tobacco by the Court here adjudged unto him for his Costs and CHarges by him about his suite in this Behalfe Laid Out and Expended and the deft in Mercy &c
