first day of November in the year of Our Lord God One thousand seven hundred twenty at the place and
County afd and within the Jurisdiction of this Court was Indebted unto the afd John in the sum of four pounds
ten shillings and three pence Curr.t money of this Governm.t for divers goods wares and merchandizes by
the same John unto the afd Solomon at the Special Instance and request of the same Solomon before
that time there sold and delivered as by an account thereof here ready in Court to be produced may appear
and so thereof Being Indebted the afd Solomon afterwards to witt the same first day of September November
in the year afd at the County afd and Within the Jurisdiction afd in Consideration thereof upon himselfe
did assume and unto the afd John then and there faithfully did promise that he the afd Solomon the same
four pounds ten shillings and three pence in Indian Corn at twenty pence P Bushell unto the same
John when thereof afterwards he should be required well and faithfully would pay and Content Nevertheless
the afd Solomon his promise and assumption afd so as it is Said made nothing regarding But minding
and fraudulently Intending the same John in this part Craftilly and Subtilly to deceive and defraud the
afd four pounds ten Shillings and three pence or any part thereof unto the same John hath not paid or in
any sort Contented altho' to doe the same the afd Solomon afterwards to witt the twentieth day of march in the
year of Our Lord God Seventeen hundred and twenty One and Often afterwards at the County afd within
the Jurisdiction afd by the afd John he was required but that unto him hither to to pay or in any sort to
Content altogether hath refused and still doth refuse to the damage of the same John of Nine pounds
and six pence Curr.t money of this Government and thereupon he Bringeth Suite &.c

    Whereupon the said Solomon Yearly alias Turpin in his Own proper person Comes and defends
the force and Injury when &.c and saith that he Cannot Gainsay the plft his action afd so as afd against him brought
nor Can he say but that the said plft Ought to recover his damages by Occasion of the premisses afd to the
sume of four pounds ten shillings and three pence ^Curr.t money&^ and Costs of Suite against him which the said plft does
not gainsay &.c    Therefore it is Considered by the Justices here the twentieth day of August ann Dom one
thousand seven hundred and twenty three that the said John Scott recover against the said Solomon Yearly
alias Turpin as well the sume of four pounds ten Shillings Curr and three pence Currt money of this
(257) Government Certain damages afd in form afd Confesed as also the sume of Two hundred and fifty
