96 June Court 1718 afd Defts the twentieth day of November Anno Domini 1716 at the parish of St. Pauls in Kent County afd and within the Jurisdiciõn of this Court by their Certain bill or writing obligatory Sealed with their Seals here into Court brought whose date is the day and year afd did acknowledge themselves to be holden unto the Said Eliza. in her life time in the Said Sume of fifteen hundred pounds of good Sound Merchtble leafe Tobacco clear of Trash & ground leaves of the afd value of fifteen pounds to be paid to the Said Eliza. in her life time when they Should be thereunto required Yet Nevertheless the afd Defts nor either of them the Said fifteen hundred pounds of Tobacco to ye Said Elizabeth in her life time while Sole nor to the Said plt — after the Espousalls between them celebrated nor to the Said Plt. Since the death of the Said Elizabeth hath hitherto paid or made content but to pay the Same to the Said Eliza. in her life time or to the Said Plt Since the Espousalls or to the Said Plt Since the death of the Said Eliza. hath hitherto refused and to the Said Plt Still doth refuse to ye damage of the Said Plt fifteen pounds of thereupon he brings Sute &ca. Johnson pr plt plds John Doe Richard Roe—— and the afd Deft. Abraham Taylor being Called came And the afd Plt by his &ca. afd Attry prays that the afd Deft. may give Special baile to the afd Accõn wch is granted And that he be kept in Safe Custody by the Sherf of Said County untill he Shall give Special baile . after which James Connalin of Said County came into Court and Acknowledged himselfe Special baile in the above accõn and doth undertake for the afd Abraham Taylor the payment of the debt afd and Cost thereon accruing if the Deft afd Should be Cast in ye Same and the Condemnation Should not Satisfie nor himselfe to the Custody of the Sherrife of Said County. deliver or that the afd James Connalin the body of the afd Abraham Taylor Shall not render &ca. After which the afd Deft Abraham Taylor came and in his proper person appeared to the above accõn And Saith that he Cannot gainsay — the Accõn afd of the afd Plt nor but that the writing obligatory above mentioned is his Act and deed and that he oweth unto the afd Plt the — Sume afd And is willing that Judgment Should be entered for the Same & Cost thereon accruing Therefore it is Considered by the Court here vizt. this — Nineteenth day of June Annoq Domini One Thousand Seven hundred and Eighteen That the afd Plt. George Commerford Administr. as afd Recover against the afd Deft Abraham Taylor as well the afd Sume of fiveteen hundred pounds of Tobacco the debt afd as also the Sume of Two hundred Eighty one pounds of Tobacco Cost by the afd Plt about his Sute in this behalf Expended and by the Court here of his assent adjudged and the Said Deft in mercy &ca ————— JamsSmith Clk |
