   Richd. Marshall | in the Provence of Maryld Planter was Summoned


to Answer unto Nathel. Pearce of a plea that he


render unto him the full and Just Sume of Twelef —
   Hundred pounds of Gud Sound Marchanable Tobackco Clear of all manner of
   trash and Ground lefes with good Sesoned Caske to Contain ye Same of the price
   and value of Tenn pounds Sterlg money which from him he unjustly detains &ca.
   And Whereupon the afd Plt. by Thomas Bowne his attry Saith that wereas the afd -
   Deft~ the Twenty Seventh day of December in the year of our Lord Christ one
   thousand Seven hundred and Sixteen at Shrewbury Parish in Kent County wthin
   the Jurisdiciõn of this Court by his Certain writing obligatory which he the Sd
   Deft~ Sealed with his Seale and as his deed delivered hereinto Court brought~
   the date whereof is the Same day & year afd Granted himselfe holden and
   firmly bound unto the afd Plt~. in the afd full and Just Sume of Twelef hundred
   poundes of Gud Sound Merchanable Tobackco Cleare of all manner of trash
   and Ground Lefes with good Sesoned Caske to contain the Same of the afd
   price & value tenn pounds Sterling money to be paid to the afd Plt~. when
   thereunto required Nevertheless the afd Deft altho’ often required the afd
   Sume of Twelve hundred pounds of Tobacco fo the afd price & value of Tenn
   pounds Sterlg money to the afd Plt~ hath not paid but to him to render or
   pay hath altogether denied and Still doth deny and unjustly detain to the
   damage of him the afd Plt Twenty pounds Sterling money and thereupon
   he brings Sute &ca.       TBowne pr Quer< r plds &ca. Jno Doe & Richd Roe
     And the afd Deft in his proper person appeared to the above accõn & prayd
   liberty thereof to imparle thereto and to Answer at next Court which was —
   granted the Same day was given the Plt in like manner
        Att which Said next Court vizt. this Eighteenth day of June Anno Domi
   one Thousand Seven hundred and Eighteen Came the afd Deft in his —
   proper person and Saith that he Cannot gainsay the Accõn afd of him the
   Said Deft~ nor but that the writing obligatory above mentioned is his
   Act and deed and is willing that Judgment Should be entered on the Sume
   and Cost thereopn accruing -   Therefore it is Considered by the Court here vizt.
   the Same day last mentioned That the afd Plt~. Nathaniel Pearce Recover
   against the Said Deft Richard Marshall as well the afd Sume of Twelve
   hundred pounds of Tobacco Debt. as also the Sume of Three hundred
   and four pounds of Tobacco Cost by the afd Plt~. about his Sute in this behalfe
   Expended and by the Court here of his assent adjudged and the Said Deft~.
   in mercy
