84 June Court 1718 of Kent County in the Province of Maryland Planter was Summoned to — answer unto Anne Anderson of a plea that he render hir the Sume of Two Thousand & four hundred pounds of good Sound Merchantable Leafe Tobacco clear of Trash and Ground Leaves in Seasoned Cask of the value of~ Twenty four pounds Sterling which from hir he unjustly detains &ca. And Whereupon the afd Plt~. by Thomas Bowne hir attry Saith that whereas the afd Deft the Twenty Eight day of February in the year of~ our Lord Christ one Thousand Seven hundred and Sixteen at St. Pauls Parish in Kent County within the Jurisdiciõn of this Court by his Certain writeing obligatory which he the Said Deft Sealed with his Seale & as his deed delivered hereinto Court brought the date whereof is the Same day & year afd granted himselfe holden and firmly bound unto the afd Plt~. in the afd Sume of Two Thousand & four hundred pounds of~ good Sound Merchantable leafe Tobacco clear of Trash and Ground Leaves in Seasoned Cask of the afd value of Twenty four pounds Sterling money to be paid unto the Said Plt~ when thereunto required yet the afd Deft~ altho’ often required the afd Sume of Two Thousand four hundred pounds of Tobacco to the Said Plt hath not paid but that to her to render or pay the Said Deft hitherto hath Denied & Still doth deny and unjustly — detain to the damage of her the Said Plt~ forty Eight pounds Sterling and thereupon She brings Sute &ca TBowne pr Querr plds Jno Doe & Rd Roe And the Said Deft in his proper person appeared to the above Accõn and prayd liberty thereof to imparle thereto and to answr. at next Court which was granted the Same day was given the Plt~ in like manner Att which Said next Court vizt. the Seventeenth day of June Anno Domini One Thousand Seven hundred and Eighteen came the afd Plt by her afd Attry but the Said Deft. hath fild no plea to the above accõn on which rule is given to the afd Deft to plead to the Same In twelve hours otherwise Judgment to be Rendered for want of the Same after which no plea being put in whereby the afd Plt~ may remain against the said Deft without defence = Therefore it is Considered by the Court here vizt. this Eighteenth day of June Anno Domini One Thousand Seven hundred and — Eighteen That the afd Plt~ Anne Anderson do Recover against the Said Deft John Atwicks as well the afd Sume of Two Thousand and four hundred pounds of Tobacco Debt as also the Sume of Three hundred and ninety four pounds of Tobacco Cost by the afd Plt~ about her Sute in this behalfe Expended and by the Court here of his assent adjudged and the Said Deft to be taken into Custody Jams Smith Clk |
