    82                                        June Court 1718
   in his proper person and Saith that he cannot gainsay the Accõn afd of him
   the Said Pltf nor but that the writing obligatory above mentioned is his
   Act and deed and that he oweth unto the afd Plt. the afd Sume of five~
   hundred & fifty pounds of Tobo and is willing that Judgment Should be
   entered for the Same & Cost thereon accruing :   Therefore it is Considered
   by the Court here vizt. the Same day last mentioned that the afd Plt. Charles
   Newman Recover against the Said Deft~ Richard Marshall as well the
   afd Sume of five hundred and fifty pounds of Tobacco Debt as also the
   Sume of Three hundred and nine pounds of Tobacco Cost by the afd Plt
   about his Sute in this behalfe Expended and by the Court here of his —
   assent adjudged and the Said Deft in mercy

   James Smith L.B: | Commanded it was to the Sherf of
                 at | Kent County the Twenty third day of Novembr
   Henry Munk — | in the third year of his Lord Ships Dominion

&ca. That he take Henry Munk of Kent County
   planter if he Shold be found in his Bailywick & him Safe keep So that
   he have his body before his Said Lord Ships Justices of the next Court to be
   held at our Court house in the Town of Chester in Said County to Answer
   unto James Smith of a plea wherefore wth. fource and Armes the Close
   of him the Said James at St. Pauls Parish in Kent County afd in the
   Jurisdiciõn of this Court he did breake & enter and a certain Gray —
   Gelding of the Said James Lately found and So provoked and outragious[:]
  :ly with Sticks and Clubbs did beat and Strike that with that provoking
   Striking and Beating did cause the Said Gelding then and there to
   runn upon a certain Thomas Smith Son and Servant of the Said —
   James Smith the Said Thomas then and there being in the Said
   James’s Service whereby the Said Servant was thrown to the —
   Ground and much hurt and wounded in his body by which the
   business of the afd James remained undone and So the Said James
   the Service of his Servant afd for a long time that is to Say for
   the Space of two months wholy lost and other injurys to him
   the Said James did to the great damage of the Said James and
   against the peace of the Said Lord proprietarie that now is and
   against an Act of Assembly in Such Case made & provided &ca.
   And that he have then and there the Said writ &ca.    .    .
        Att which Said next Court vizt. the Eighteenth day of March
   the Same yeare last mentioned the day of return of Said writ came
   Simon Wilmer Gent~. high Sherf of Said County and made return
   thereof in these words thereon Endorsed as folls vizt. Cepi Corpus pr S:Wilmer
