   78                                       June Court 1718
   Earle his attorney Says that whereas the afd George Hill at Chester old Town
   in Kent County afd and within ye Jurisdiciõn of this Court to witt the Sixth day
   of September Anno Domini One Thousand Seven hundred and Eleven by his
   certain writing obligatory had granted himselfe to be holden & firmly bound
   to ye Said Amos in ye afd Sum of Twenty Seven pounds Eight Shillings and
   two pence Current money of Maryland afd to be paid to ye Same Amos Garrett
   his heires Exrs. Admrs. factors or assigns when after thereunto he had been
   required Nevertheless the afd George Hill altho’ often required ye afd Sum of
   Twenty Seven pounds Eight Shillings & two pence Current money afd to ye Same
   Amos hath not rendered but ye Same to him to render hath Gainsayd and -
   Still doth gainsay wherefore he Says he is ye worse and hath Lost to ye value
   of thirty pounds Currt. money of Maryland afd & therefore he brings this Sute
   &ca. And he brings into Court ye writing obligatory afd which Testifies ye debt
   afd whose date is ye Same day & year &ca. JEarle pr Querr plds &ca. Jno Doe Rd Roe
   And the afd Deft~ by Thomas Bowne his attry cames and appear’d to the
   above Accõn and prayd liberty thereof to imparle thereto and to answer
   at next Court which was granted the Same day was given the Plt. also
   Att which Said next Court vizt. the Twentieth day of November Anno —
   Domini One Thousand Seven hundred and Sixteen the Same cause
   was Continued untill the then next Court in Course
        Att which Said next Court vizt. the Nineteenth day of March the
   Same year last mentioned the Same cause was Continued untill the
   then next Court in Course
      Att which Said next Court vizt. the Eighteenth day of June Anno Domi
   one Thousand Seven hundred and Seventeen the Same cause was
   Continued untill the then next Court in Course
    Att which Said next Court vizt the Twentieth day of August the Same
   year last mentioned the Same cause was Continued untill the then
   next Court in Course
      Att which Said next Court vizt. the Nineteenth day of November the
   Same year last mentioned the Same cause was Continued untill the
   then next Court in Course
      Att which Said next Court vizt. the Eighteenth day of March the Same
   year last mentioned the Same cause Standing for tryall came the afd Plt
   by his attry afd and the Said Deft by his Said attry and pleads as folls vizt.
   And the afd George by Thomas Bowne his attry Comes and defends the
   force and Injury when &ca. And prays &ca. which being read &ca. And by —
   protestation that ye afd above obligation is not the Act & deed of the Sd
   George for plea Saith that the afd Amos his Accõn afd against hime the Sd
   George to have and maintain ought not because he Saith that he the
