June Court 1718 73 value of five pounds Sterling money which from him he unjustly detains &ca. and that he have then and there the Said writ &ca. Att which Said next Court vizt. the Seventeenth day of June Anno Domini One Thousand Seven — hundred and Eighteent the day of return of Said writ came Simon Wilmer Gent high Sherf of Said County and made return thereof in these words — thereon Endorsed as folls vizt. Cepi Corpus pr S:Wilmer Sherf And A Decln being filed when Said writ Issued forth and a Copy thereof— Served therewith according to Act of Assembly in Such case made was as folls vizt. Kent County Ss. Thomas Morell of Kent County Planter als Dics Thomas Morell of Queen Annes County Planter was Summoned to Answer unto Thomas Bowne of a plea that he render him the Sume of five hundred pounds of . good Sound Merchantable Tobacco in Cask of the value of five pounds — Sterling money which from him he unjustly detains &ca And Whereupon the afd Plt~ in proper person Saith that Whereas the afd Deft~ the Twenty Sixth day of November in the year of our Lord Christ one Thousand Seven hundred and thirteen at St. Pauls Parish in Kent County . within the Jurisdiciõn of this Court by his certain writing obligatory which he the Said Deft~ Sealed with his Seale and as his deed delivered hereinto Court brought the date whereof is the Same day & year afd granted himselfe holden and firmly bound unto the afd Plt. in the afd Sume of five hundred — pounds of good Sound Merchantable Tobacco in Cask of the afd value of five — pounds Sterling money to be paid unto the Said Plt when thereunto required yet the afd Deft~ altho’ often required the afd Sume of five hundred pounds of Tobacco unto the Said Plt~ hath not paid but that to him to render or pay the Said Deft~ hitherto hath denyed and Still doth deny and unjustly detain to the Damage of him the Said Plt~ Tenn pounds Sterling money and thereupon— he brings Sute &ca. Jno Doe TBowne pr Prsona John Johnson plds & Richd Roe— And the afd Deft~. being called came and the afd Plt~ prays that the Said Deft~ may give Special baile to the afd Accõn which is granted and that he be kept in Safe Custody by the Sherf of Said County untill he Shall give Speciall baile as afd After which William Simson of Said County here in Court cometh and Acknow: :ledged himselfe as Special baile in the afd Accõn and doth undertake for the afd Deft~ the payment of the Debt afd and Cost thereon accruing if the Said Deft~ Should be Cast in the Same and the Condemnation Shall not~ Satisfie nor himselfe to the Custody of the Sherf of Said County deliver or that the afd William Simson the body of the afd Deft~ Shall not render &ca. and the afd Deft in his proper person appeared to the afd Accõn and Saith that he Cannot gainsay the Accõn afd of him the Said Plt~ nor but that the writing obligatory above mentioned is his Act~ and deed and that he oweth unto the afd Plt. the afd Sume of five hundred pounds of Tobacco and is willing that Judgment Should be Entered for the Same & Cost thereon accruing : Therefore it |
