     72                                        June Court 1718
   Endorsed as folls vizt. May ye 28th: 1718 Then came the within na,ed Parker
   Roe and made Oath to the within Account According to Act of Assembly —
   before me    Rd: Tilghman~
     And the afd Plt~ by his afd attry prays that the Sd Deft~ may to his Decln afd Answr.
   And the afd Deft~. being called came and the Said Plt. by his attry afd prays -
   that the Said Deft~ may give Speciall baile to the afd Accõn which is granted
   and that he be kept in Safe Custody by the Sherf of Said County untill he
   Shall give Speciall baile
     After which William Pope of Said County here in Court came and Acknowledg
  :ed himselfe as Special baile in the afd Accõn and doth undertake the payment
   of the Damages afd & Cost thereon accruing if the Said Deft~ Shall be cast in
   the Same and the Condemnation Shall not Satisfie nor himselfe to the
   Custody of the Sherf of Said County deliver or that the afd William Pope
   the body of the afd Deft Shall not render &ca.
    And the afd Deft in his proper person appears to the above Accõn and Saith
   that he cannot gainsay the accõn afd of him the Said Plt nor but that the
   Damages above mentioned is what he is indebted to ye afd Plt and is willing
   that Judgment Should be Entered for the Sume of five hundred fifty two
   pounds of Tobacco & Cost~ thereon accruing : Therefore it is Considered by the
   Court here vizt this Eighteenth day of June Anno Domini One Thousand Seven
   hundred and Eighteen That the afd Plt~ Parker Roe Recover against~-
   the Said Deft~ Nathaniel Dunnohoo as well the Sume of five hundred -
   & fifty two pounds of Tobacco Damages as also the Sume of Three hundred
   fifty Eight pounds of Tobacco Cost by the afd Plt~ about~ his Sute in this
   behalfe Expended and by the Court here of his assent adjudged and the Said —
   Deft~ in mercy &ca

   five hundred pounds of good Sound Merchantable Tobacco in Cask of the
