   Attorney Complaineth that whereas the afd Deft~ vizt. the Seventh day of —
   December in the year of our Lord Christ one Thousand Seven hundred and -
   Seventeen at St. Pauls Parish in Kent County within the Jurisdiciõn of this Cour[t]
   In Consideration that the afd Plt~ at the Speciall instance and request of the
   afd Deft~ had then and there Sold and delivered unto the afd Deft~ and to the prope[r]
   use and behoofe of the afd Deft~ divers goods and Merchandizes for the Sume of
   five hundred and fifty two pounds of Merchantable Tobacco in manner as-
   in the Accot~. hereto Annext at the Severall rates and prices Set forth upon himself[e]
   assumed and to the Said Plt~ then and there faithfully promised that he the Said
   Deft~ the afd Sume of five hundred and fifty two pounds Merchantable Tobo.
   to the Said Plt~ when thereunto required would well and truly pay and Content~ —
   And that whereas also the afd Deft~ afterwards vizt. the afd Seventeenth day of
   December in the Year afd at the Parish County and Jurisdiciõn and In Consideration
   that the afd at the like Speciall instance and request of the afd Deft~ had then-
   and there last mentioned Sold and delivered unto the afd Deft~ and to the proper
   use and behoofe of the afd Deft~ divers goods and Merchandizes in Said Accot~.—
   hereunto Annexed Sett forth upon himselfe assumed and to the Said Plt~ then
   and there last mentioned faithfully promised that he the Said Deft~ So much~
   Merchantable Tobacco as the afd last mentioned Goods and Merchandizes Sold &
   delivered as last Said at the time of the Sale & delivery thereof at reasonable
   rates and prices were worth and Amounted to unto the Said Plt~ when——
   thereunto required would well and truly pay and Content and the afd Plt~ in:
  :deed Saith that the afd last mentioned Goods and Merchandizes Sold and delivered
   as last Said at the time of the Sale and delivery thereof at reasonable Rates
   and prices were worth and amounted unto the Sume of five hundred and fifty
   two pounds of Merchantable Tobo in manner as in the Said Accot~. Set forth of which-
   the Said Deft then and there last mentioned had Notice Nevertheless the afd Deft~
   his promises and Assumptions afd in forme afd made litle regarding but
   plotting and fraudulently Intending him the Said Plt of the afd Severall —
   Summes of Tobacco which in the whole amounts Unto the Summe of Eleven
   hundred and four pounds of Tobacco craftily and Subtilly to deceive and defraud
   the afd Sume of Eleven hundred and four pounds of Tobacco to the Said Plt~ altho’
   often after at the Parish County and Jurisdiciõn afd was thereunto required hath
   not paid nor made Content for the Same but that to him to pay or Content~ the Said
   Plt~. Eleven hundred pounds of Merchantable Tobacco and thereupon he brings
