June Court 1718 69 Maryland which from him he unjustly detains &ca. and that he have then & there the Said writ &ca. . . . Att which Said next Court vizt. the Seven :tenth day of return of Said writ came Simon Wilmer Gent: high Sherf of Said County and made return thereof in these words thereon Endorsed as folls vizt. Cepi Corpus pr Simon Wilmer Sherf And A Decln being fild when Said writ Issued forth and a copy thereof Served therewith according to Act~ of Assembly in Such case made was as folls vizt. Kent County Ss Garrett Clossey of Kent County Planter alis Dics Garre[tt] Clossey of New Castle Coty. in the Province of Pensilvania was Summoned to Answer unto John Roberts of a plea that he render him the full And just Summe of Three pounds Sixteen Shillings and Six pence New Current money of New~- castle at Six Shillings and tenn pence to the ounce of the value of three pounds Sixteen Shillings & Six pence Currant money of Maryland which from him he unjustly detains &ca. And Whereupon the afd Plt by Thomas Bowne his attorney Saith that whereas the afd Deft~ the thirteenth day of~ June in the Year of our Lord Christ one Thousand Seven hundred and thirteen at St. Pauls Parish in Kent County within the Jurisdiciõn of this Court by his certain writing obligatory which he the Said Deft Sealed with his Seale and as his deed delivered hereinto Court brought the date whereof is the Same day & Year afd granted himselfe holden and firmly bound unto the afd Plt in the afd full and just Summe of three pounds Sixteen Shillings and Six pence new Currant~ money of Newcastle at Six Shillings and tenn pence to the Ounce of the value of three pounds Sixteen Shillings and Six pence Currant money of Maryland to be paid unto the Said Plt~. when thereunto required Yet the afd Deft altho’ often required the afd Sume of three pounds Sixteen Shillings and Six pence new Currant money of Newcastle to the Said Plt~ hath not paid but that to him to render or pay the Said Deft~ hitherto hath denyed and Still doth deny and unjustly detain to the damage of him the Said Plt~ Six pounds Currant money of Maryland afd & thereupon he brings Sute &ca. TBowne pr Querr Plds Jno. Doe & Richd Roe~ And the afd Plt~ by his attry afd prays that the Said Deft~ to his Decln afd may Answer and the afd Deft in his proper person appeared to the above accõn and Saith that he cannot gainsay the Accõn afd of him the Said Plt nor but that the writing obligatory above mentioned is his Act and deed and that he oweth unto the afd Plt~. the afd Sume of Three pounds Sixteen Shillings and Six pence Currant money and is willing that Judgment Should be entered for the Same & Cost thereon accruing : Therefore it is Considered by the Court here vizt. this Eighteenth day of June Anno Domini One Thousand Seven hundred & Eighteen That the afd Plt~ John Roberts do recover against the Said Deft Garrett . Clossey as well the afd Sume of Three pounds Sixteen Shillings and Six pence Currant money Debt as also the Sume of two hundred Sixty five pounds of Tobacco Cost by the afd Plt~ about his Sute in this behalfe Expended and by the Court here of his assent adjudged and the Said Deft~ in mercy &ca.
