    68                                       June Court 1718
   within the Jurisdiciõn of this Court by his certain writeing obligatory which he
   the Said Deft~ Sealed with his Seale and as his deed Delivered hereinto Court.
   brought the date whereof is the Same day & Year afd granted himselfe holden—
   and firmly bound unto the afd John Browne in his life time in the afd full
   Sume of fourteen hundred and Six pounds of good Sound Merchantable Leafe~
   Tobacco in Cask to Contain the Sume of the afd value of fourteen pounds Sterling
   money to be paid unto the Said John Browne his Exrs. Admrs. or Assignes when
   thereunto required Yet the afd Deft~ altho’ often required the afd Sume of fourteen
   hundred and Six pounds of Tobacco to the Said John Browne in his life time
   or after the death of the Said John Browne to the afd Elizabeth while Sole or to
   the afd Richard and Elizabeth after Espousalls between them Celebrated or to
   any of them hath not paid but that to the Said John Browne in his life time
   to pay altogether denied and after the death of the Said John to the Said—
   Elizabeth while Sole and to the Said Richard & Elizabeth after Espousalls
   Between them Celebrated to pay hitherto hath deneyed and Still doth deny
   and unjustly detain to the damage of them the Said Plts. Twenty Eight pounds
   Sterling money and in Delay of the Execution of the Testament afd they —
   thereupon bring Sute & brings into Court the Letters Testamentary which—
   Testitie &ca.                      TBowne pr quer plds John Doe & Richard Roe
   And the afd Plts. by their attorney afd prays that the Said Defts to the Decln afd
   may Answer And the afd Deft~. in his proper person appears to the above
   Accõn and Saith that he Cannot gainsay the Accõn of them the Said Plts
   nor but that the writeing obligatory above mentioned is his Act & deed and .
   that he oweth unto the afd Plts the afd Sume of fourteen hundred and Six~~
   pounds of Tobacco and is willing that Judgment Should be entered for -
   the Sume & Cost thereon Accruing: Therefore it is Considered by the Court here
   vizt. this Eighteenth day of June Anno Domini One Thousand Seven hundred
   and Eighteen That the afd Richard Burrough and Elizabeth his wife Exrx.
   of the afd John Browne decd. Recover against the Said Deft~ Garret Clossey
   as well the afd Sume of fourteen hundred and Six pounds of Tobacco Debt~.
   as also the Sume of Two hundred Sixty Nine pounds of Tobacco Cost by the
   afd Plts about their Sute in this behalfe Expended and by the Court here of his
   assent adjudged and the Said Deft~ in mercy &ca —

           at | first day of March in the third Year of his Lordships Domini:
   Garrett Clossey | :on &ca. That he take Garrett Clossey of Kent County Planter als .

   if he Should be found in his Bailywick & him Safe keep So that he have his body
   before his Said Lord Ships Justices of the next Court to be held at our Court house in~
   the Town of Chester in Said County to Answer unto John Roberts of a plea that
   he render him the full and just Sume of Three pounds Sixteen Shillings and Six pence
   new Current money of New castle at Six Shillings and tenn pence to the ounce of
   the value of Three pounds Sixteen Shillings & Six pence Currant money of~
                                                                                                     Maryland
