June Court 1718 67 in this behalfe Expended and by the Court here of his assent adjudged and the Said Deft~ in mercy &ca. Whereas an Accõn was Commenced Novbr. Court last against Simon Tillett in the Writ and Decln in the afd Accõn mentioned at the Sute of a certain William Nicholson Returnable to March Court then next following but for as much as the Said Simon Tillett made default and did not appeare to the Said Accõn against him And the afd Peter Reade being baile for the afd Simon Tillett on which at the afd March Court the baile bond of the afd Simon Tillett and Peter Read was assigned over by Simon Wilmer Gent~. high~ Sherife of Said County in open Court at the afd March Court on which the above acc#&245n was Commenced And now at this Court came Michael Miller attorney in fact. the afd William Nicholson and Saith that on payment of the Damages in the first Accõn brought and the Cost on the Same as also on the payment of the Cost in the above Accon he will Acknowledge Satisfacõn~ in full for the above Judgment~. his Said Lordships Justices of our next Court to be held at our Court house in the Town of Chester in Said County to Answer unto Richard Burrough and Elisabeth~ his wife late Called Elizabeth Browne Executrix of the last will and Testament~. of John Browne late of Baltemore County Deceased of a plea that he render them~ the Sume of fourteen hundred and Six pounds of good Sound Merchantable leafe Tobacco in Cask to contain the Same of the value of fourteen pounds Sterling money which from them he unjustly detains &ca. And that he have then and there the Said writ &ca. . . . . Att which Said next Court viz the Seventeenth day of June Anno Domini One Thousand Seven hundred and Eighteen the day of return of Said writ came Simon Wilmer Gent~. high Sherf of Said County and made return thereof in these words thereon Endorsed as folls vizt.
