66 June Court 1718 that he have then & there the Said writ &ca Att which Said next Court vizt. the Seventh day of June Anno Domi One Thousand Seven hundred & Eighteen the day of return of Said writ came William Ringgold Gent~ one of the Coroners of Kent County and made return thereof in these words — thereon Endorsed as folls vizt. Cepi Corpus Peter Read pr Willm Ringgold Coror: And a Decln being fild when Said writ Issued forth & a Copy thereof Served therewith according to Act of Assembly in Such Case made was as folls vizt Kent County Ss Simon Tillett. of Kent County Planter and Peter Reade of Kent~ County Planter alis Dics Simon Tillett and Peter Reade of Kent County in the Province aforesd Planters were Summoned to Answer unto Simon Wilmer Sheriff of Sd County of a plea that they render him the Summe of Eight~. Thousand pounds of good Sound Merchantable Lefe Tobacco in Cask to Contain the Same of the value of Thirty four pounds Sterling Money which from him they unjustly detain &ca. And Whereupon the afd Plt~ by Thomas Bowne his attorney Saith that whereas the afd Deft~. the Twenty Seventh day of January in the Year of our Lord Christ one — Thousand Seven hundred and Seventeen at St. Pauls Parish in Kent County within the Jurisdiciõn of this Court by their certain writing obligatory — which they the Said Defts Sealed with their Seales and as their deeds — delivered hereinto Court brought the date whereof is the Same day & year afd granted themselves holden and firmly bound unto the afd Plt~ then Sherff of Said County being by the name of Simon Wilmer high— Sheriff of Said County in the afd Sume of Eight Thousand pounds of good Sound Merchantable Leafe Tobacco in Cask to Contain the Same of the afd value of Thirty four pounds Sterling money to be paid unto the afd Plt~ — convenient in the Said County when thereunto required Yet the afd Defts or any or either of them altho’ often required the afd Sume of Eight Thousand pounds of Tobacco to the Said Plt~ hath not paid but that to him to render or pay they the Said Defts and every of them hitherto hath denyed & Still doth deny and unjustly detain to the damage of him the Said Plt~ Sixty Eight pounds Sterling money and thereupon he brings Sute &ca TBowne pr:qr plds Jno Doe & Rd Roe~~ And the afd Plt~ by his afd Attry. prays that the afd Peter Read to his afd Decln may Answer And the afd Peter in his proper person appeared to the above Accõn and Saith that he Cannot gainsay the Accon afd of him the Said Plt~. nor but that the writing obligatory above mentioned is his Act~. and deed and is willing that Judgment Should be entered for the Same as above — Therefore it is Considered by the Court here vizt this Eighteenth day of June Anno Domini One Thousand Seven hundred and Eighteen That the afd Plt~ Simon Wilmer Sherf Recover against the Said Peter Reade as well the afd — Sume of Eight Thousand pounds of Tobacco Debt as also the Sume of Three hundred and fifty pounds of Tobacco Cost by the afd Plt~ about his Sute in |
