August Court 1720 54[7] And the afd. Deft. by Thomas Bowne his Attorney Comes and defends the force and Injury when &c and Saveing to him all and all manner of Exceptions and Advantag[es] as well to the writt in the said accõn as also to the Decln to the same writt pray’s leave [to] imparle thereto and to answere at next Court and he hath it and the same day is given [to] [the] pltf also. At which said next Court vizt. the 16th. day of August anno Domi 1720 Came [as] [we]ll the afd. pltf by his afd Attorney as also the afd. Deft. by his said attorney And the [afd] Deft. Offers himself against the said pltf in the accõn afd. But the said pltf by [Dav]id Macbride his Attorney afd. Says that he will not prosecute the same action an[y] [fur]ther So that the said Deft. remains wholly unprosecuted by the said pltf in the ac[cõn] Therefore it is Considered by the Court here this 17th: day of August [Anno Domi] 1720 afd. That the said William Edwards take nothing by his writt or [decl]aration afd. but be in mercy for his false Clamor and that the said William [B]oyers goe thereof without Day and it is also Considered that the said William [B]oyers Recover against the said William Edwards the sum of One hundred and Ninty Nine pounds of Tobacco by the Court here adjudged to him for his Costs and Charges by him about his Suit in this behalfe laid out and Expended according to the Statute &c. [t]o the [jurors] unknown and in the mean time to be of good behaviour G[eorge] Macay afd. present here in Court Acknowledges himself indebted to his Lord[=] ship the [Lo]rd Proprietary of this province his heires and Successors in the Sum of Ten pounds Sterling money to be Leveyed on his goods and Chatles Lands and [Ten]ements Conditionally that if he does not appear at next Court to be held for sd. County to answer the afd. Indictment and Stand and abide the Deteremination of of the said Court thereupon and in the mean time to be of good behaviour wherewith he acknowledges himself Content. Robert Macay and John Clark both of Kent County present herein Co[urt] Acknowledge themselves Indebted to his Lordship the Lord Proprietary of this Province in the Summ of five pounds Sterlg money each to be Leveyed on their Goods Chatles Lands and Tenements Conditionally that if the afd. George Macay [do] not appear and answer as afd. and in the mean time be of Good behaviour wherewith they acknowledge themselves and either of them Content. |
