   542                                           August Court 1720 .
   faithfully promised that he the said Def^t. the af^d. Sum or Quantity of six hundred po[unds]
   of Merchantable Tobacco to the said plt^f when thereunto afterwards he should be required
   would well and truely pay and Content Nevertheless the af^d Def^t. his promises and as=
   sumptions af^d. in form af^d. made in no wise regarding but plotting and fraudu[=]
   lently Intending the af^d Plt^f in this behalf Craftily and Cunningly to deceive and
   defraud the af^d. Sums or Quantitys of merchantable Tobacco in the whole amou[n=]
   ting unto twelve hundred pounds of Merchantable Tobacco or any part thereof to
   the said plt^f hath not paid nor in any wise made Content altho to do the same the af^d
   Def^t afterwards viz^t. the sixteenth day of Aprile in the year of our Lord Christ one
   thousand seven hundred and nineteen at the parish County and Jurisdiction
   af^d. and often afterwards by the said plt^f. was thereunto required but that to [him]
   to pay or Content hitherto hath refused and still doth refuse to the dama[ge]
   of him the said plt^f two thousand four hundred pounds of merchantable [tobacco]

   And the af^d. Def^t. in his proper person Comes and Defends the force and Injury
   when &c. and prays leave to imparle thereto and to answer at next Court and
   he hath it, and the same day is given to the plt^f also
        At which said next Court Viz^t. the 21^st day of June anno Domⁱ 1720 Came as well
   the said plt^f by his attorney af^d. as also the said Def^t in his proper person and Rule
   is given to the said Def^t. to plead, and that he put in his plea to the af^d. action Ten
   days after Court otherwise Judgement to be rendered in the af^d Action against
   the said Def^t. for want of a plea, and thereupon the same is Continued untill next
   Court
        At which said next Court viz^t. the 16^th: day of August anno Domⁱ 1720 af^d. Came
   as well the af^d. plt^f by his attorney af^d. as also the said Def^t. in his proper person
   and no plea being put in to the said accõn by the af^d Def^t according to the Rule
   af^d. but he the said Def^t. haveing therein made Default whereby the af^d. Plt^f
   remains against the said Def^t. without Defence.    Therefore It is Con[=]
   sidered by the Court here viz^t. the 17^th: day of August anno Domⁱ 1720 that
   the said William Mackey Recover against the said John King as well the
   Summ of Six hundred ——————————————— pounds
   of Tobacco Damages as also the Sum of Two hundred and thirty Two ——
   pounds of Tobacco by the Court here adjudged to him for his Costs and Charges
   by him about his Suit in this behalf laid out and Expended and the Def^t
   in Mercy &c
