540 August Court 1720 Called come not but make default nor does any other person appear or Shew Cau[se] Thereupon Undertakes for the said Edward Mitchell That in Case the said Josiah Richardson Shall at any time within a Year and a day appear and make all or any part of the afd. Edward Mitchell his Claime against him appear to be satisfied or otherwise to have been undue before the laying on of this attachment that then the said Edw[ard] Mitchell Shall make Restitution to the said Josiah Richardson of all or such pa[rt] thereof as Shall be made appear to be undue &ca. or that he the said will do it for him Therefore it is Considered by the Court here this 17th. of August anno [Domi] 1720. that the afd Sum of one thousand pounds of Tobacco of the afd. value of [four] pounds three Shillings and four pence Currant money so as afd. Attached in the hands of Hermanius Schees, as also the afd. Sume of four hundred pounds of Tobacco of the afd. value of one pound thirteen Shillings and four pence Currant mon^ey afd. So as afd. Attached in the hands of William Thorton as also the afd Sum of Three hundred and thirty three pounds of Tobacco of the afd. Value of One pound Six Shillings and Six pence so as afd Attached in the hands of John Greenwood be Condemned in the hands of the severall persons afd. as the Goods and Chatles Rights and Credits of the afd: Josiah Richardson towards Satisfying to the afd: Edward Mitchell as well part of his Damages recovered in the plea afd. as part of his Costs and Charges accrueing on the premisses afd. and that the Said Edward Mitchell have his Execution against the severall per Sons afd. according to Act of assembly &ca.
