June Court 1718 53 any the Goods Chattells Rights or Credits of Symon Tillett of Kent County Planter if~ they Shall be found in your Bailywick to the value of Nine Thousand pounds of~ Tobacco & when y.o have the Same So attached or any part thereof the Same in yor. Custody Safe keep So that yo. have them before the Justices of our next County Court to be held at our Court house in the Town of Chester in Said County on the third Tuesday in June next then & there to be Condemned According to Act of Assembly to & for the use of a Certain Peter Read unless he the Said Symon Tillett by himselfe or his attry Shall appear & answer unto the Said Peter Read in a plea of Trespass upon the Case according to Law and that by good & Lawfull men of yor. Baylwick y.o make known unto the Person or persons in whose hands y.o make ye Same attachment~ that he She or they be and appear before the Justices of our Said Court to be held as afd to Shew cause if any he She or they have . why the Same goods Chattells rights or Credits So attached in his her or there hands ought not to be Condemned according to Law if to him or them it Shall Seem meet and how y.o Shall Execute this writ that y.o make known unto our Said Justices at the day & place afd and have y.o then and there this writ Witness Nathaniel Hynson Gent. chiefe Justice of our Said Court this 21st. day of March in the Second Year of our Dominion &ca. Anno Domini 1717 TBowne pr Jams Smith Clk Att which Said next Court vizt. the Seventeenth day of June Anno Domini one Thousand Seven hundred and Eighteen the day of Return of Said writ came Simon Wilmer Gent~ high Sherf of Said County and made return thereof in these words thereon Endorsed as folls vizt. By vertue of the within writ to me directed I Certifie to the Justices within mentioned that I have Attached of the Goods and Chattells of the within named Simon Tillot~ One Sorrill Horse one Sadle one bridle of the price & value of Six hundred pounds of Tobacco in the hands of the within named Peter Read to Satisfie unto the Sd Peter Read part of the Sume of Nine Thousand pounds of Tobacco and have made known unto the Said Peter Read that he be and appear at the time and place within mentioned to Shew cause if any he has why the Said Goods and Chattells Attached as afd ought not to be Condemned according to Law before James Murphey & John Cooper two good & Lawfull men of my Bailywick and So Answers Simon Wilmer Sherf And the afd Plt by Thomas Bowne his attry prays Judgment for Condemnation of the afd Sorrill horse Sadle & bridle of the afd Price & value of Six hundred pounds of Tobacco : Therefore it is Considered by the Court here vizt this Eighteenth . day of June Anno Domini One Thousand Seven hundred and Eighteen That the - afd Sorrill horse Sadle & bridle of the price and value of Six hundred pounds of Tobacco the goods and Chattells of the afd Deft~. be Condemned to the use of the afd Plt~. and that the afd Plt have thereof Execution he the Said Plt~ giving Surety before Execution be made that if the afd Deft. by himselfe or his attry Should come in and appeare to the orriginall Accon within a Year and a day and make it appear that the Same is Satisfied or any part thereof then |
