   528                                          August Court 1720
   Whereupon The af^d. Plt^f not liveing in this County Thomas Bowne Attorney for
   the Same plt^f present here in Court takes upon him the payment the Costs in the
   Action af^d. to the S^d Def^t. provided the Said Def^t. Shall apear and answer unto
   the Said Plt^f in the Action af^d. and the af^d. Plt^f Shall be non Suit therein.
        Whereupon at the prayer of the plt^f by his Attorney af^d. the Def^t is ad:
   judged to give Speciall Bail and that the Sheriff of S^d. County keep the Said Def^t
   in Safe Custody untill he give Special Bail to the Action af^d. Thereupon
   John March and Thomas Thackston both of Kent County present here in
   Court Joyntly and Severally undertake for the Said Alexander Ross that
   in Case the said William Cox Shall Recover Judgement in the plea af^d.
   against the said Alexander Ross or that the the Said Alexander Ross [shall]
   be therein Convict that then he the Said Alexander Ross Shall pay the Condem
   nation of the Court thereupon or Render his body to the Custody of the Sheriff
   of S^d County in Satisfaction thereof or that they the Said John March and
   Thomas Thackston or one of them will do it for him.
        Whereupon the af^d. Def^t. in his proper person Comes and defends the
   force and Injury when &c. and prays leave to imparle thereto and to
   answer at next Court and he hath it, and the Same day is given to the
   plt^f also.

TB. Edward Mitchell	\|	This being an Action of Trespass on the Case Com=
a^t	\|	menced by the Said Plt^f against the Said Def^t. and
John Ryall —–	\|	wherein the Sheriff of Said County to whome the writt
		in the Said action was directed Makes Return to the

   Court here the third Teusday of August Viz^t: the 16^th day of the Said Month anno
   Domⁱ 1720. being the day of Return of Said writt Endorst Cepi Corpus per Gideon
   Pearce Sheriff.
        Kent County Maryland S^t. John Ryall of Kent County Planter
   was attached to answer Unto Edw^d: Mitchell of a plea of Trespass on the Case
        And whereupon the af^d. Plt^f by Thomas Bowne his attorney Complains that
   whereas the af^d. Def^t. the twentieth day of June in the Year of our Lord Christ one
   thousand Seven hundred and Twenty at S^t Pauls parish in Kent County within the
   Jurisdiction of this Court had accounted together of and Concerning diverse Sums
   of Tobacco to the Same plt^f by the Same Def^t. before that time oweing and unpaid
   and upon that accounting the Said Def^t. was found in Arearage to the Said Plt^f. in
   the Sume of Seven hundred and thirty three pounds of Merchantable Tobacco and so
   being found in Arrearage the af^d Def^t in Consideration thereof afterwards viz^t.
   on the twenty Eight day of June in the Year af^d. at the parish County and Ju=
   risdiction af^d. upon himself assumed and to the said Plt^f then and there
   faithfully promised that he the said Def^t. the af^d Summ of Seven hundred and
