   thirty three pounds of merchantable Tobacco to the af^d. plt^f when thereunto required
   would well and truly pay and Content Nevertheless the af^d Def^t. this promises and
   assumptions af^d. in form af^d. made as to the af^d. Sume of Tobacco amounting to the Sum
   of Seven hundred pounds of Tobacco litle regarding but ploting and fraudulently in=
   tending him the Said plt^f in that behalf Craftily to deceive and defraud the af^d. Sum
   of Seven hundred and thirty three pounds of merchantable Tobacco to the af^d. Plt^f
   hath not paid altho to pay the Same the said def^t. afterwrads viz^t. the af^d twenty
   Eight day of June in the year af^d. at the parish County and Jurisdiction af^d. by the
   af^d plt^f. was thereunto required But that to the Said plt^f to pay or Content he the
   Said Def^t. hitherto hath deneyed and still doth deney to the Damage of the af^d plt^f
   one thousand pounds of like Tobacco af^d. and thereupon he brings Suite &c

   Whereupon at the prayer of the plt^f the Def^t is adjudged to give Special Bail to
   the action af^d. and that the Sheriff of S^d County keep the said Def^t in Safe Custody
   untill he Shall give Baill as af^d.
      And the af^d Def^t. in his proper person Comes and Defends the force and Injury
   when &c. And Says that he Cannot gainsay the plt^f his action So as ag^st:
   him brought nor Can he Say but that the Said plt^f ought to recover his dama=
   ges by occasion of the premisses af^d. to the Sum of Seven hundred and thirty
   three pounds of Tobacco with Costs of Suit against him which he the S^d plt^f doth
   not Gainsay Therefor It is Considered by the Court here this 17^th
   day of August Anno Domⁱ 1720 That the af^d. Edward Mitchell Recover
   against the af^d. John Ryall as well the Sum of Seven hundred and thirty three
   pounds of Tobacco his damages af^d in form af^d. Confessed as also the Sum
   of Two hundred and fifty —————————— pounds of Tobacco
   by the Court here adjudged to him for his Costs and Charges by him About his Suit
   in this behalf laid out and expended And the Def^t in mercy &c.

a^t	\|	This being an action of Trespass on the Case Commen:
John Ryall —	\|	ced by the S^d plt^f against the Said Def^t. And wherein the
		Sheriff of said County to whom the writt in the Said Action

   was directed makes Return to the Court here the 16^th. day of August anno Domⁱ 1720
   being the day of Return of the Same Writt Endorst Cepi Corpus p^r Gideon Pearce
   Sheriff
           Kent County Maryland Ss. John Ryall of Kent County Planter was
   attached to answer unto Edw^d Mitchell of a plea of Trespass on the Case —
        And whereupon the af^d Plt^f by Thomas Bowne his attorney Complains that where
   as the af^d. Def^t. the fifteenth day of July in the Year of our Lord Christ one thousand
   Seven hundred and Twenty at S^t. Pauls parish in Kent County within the Jurisdiction
