   thirty three pounds of merchantable Tobacco to the afd. pltf when thereunto required
   would well and truly pay and Content Nevertheless the afd Deft. this promises and
   assumptions afd. in form afd. made as to the afd. Sume of Tobacco amounting to the Sum
   of Seven hundred pounds of Tobacco litle regarding but ploting and fraudulently in=
   tending him the Said pltf in that behalf Craftily to deceive and defraud the afd. Sum
   of Seven hundred and thirty three pounds of merchantable Tobacco to the afd. Pltf
   hath not paid altho to pay the Same the said deft. afterwrads vizt. the afd twenty
   Eight day of June in the year afd. at the parish County and Jurisdiction afd. by the
   afd pltf. was thereunto required But that to the Said pltf to pay or Content he the
   Said Deft. hitherto hath deneyed and still doth deney to the Damage of the afd pltf
   one thousand pounds of like Tobacco afd. and thereupon he brings Suite &c

   Whereupon at the prayer of the pltf the Deft is adjudged to give Special Bail to
   the action afd. and that the Sheriff of Sd County keep the said Deft in Safe Custody
   untill he Shall give Baill as afd.
      And the afd Deft. in his proper person Comes and Defends the force and Injury
   when &c. And Says that he Cannot gainsay the pltf his action So as agst:
   him brought nor Can he Say but that the Said pltf ought to recover his dama=
   ges by occasion of the premisses afd. to the Sum of Seven hundred and thirty
   three pounds of Tobacco with Costs of Suit against him which he the Sd pltf doth
   not Gainsay   Therefor It is Considered by the Court here this 17th
   day of August Anno Domi 1720 That the afd. Edward Mitchell Recover
   against the afd. John Ryall as well the Sum of Seven hundred and thirty three
   pounds of Tobacco his damages afd in form afd. Confessed as also the Sum
   of Two hundred and fifty —————————— pounds of Tobacco
   by the Court here adjudged to him for his Costs and Charges by him About his Suit
   in this behalf laid out and expended   And the Deft in mercy &c.

      John Ryall —           | ced by the Sd pltf against the Said Deft. And wherein the


Sheriff of said County to whom the writt in the Said Action
   was directed makes Return to the Court here the 16th. day of August anno Domi 1720
   being the day of Return of the Same Writt Endorst Cepi Corpus pr Gideon Pearce
   Sheriff
           Kent County Maryland Ss. John Ryall of Kent County Planter was
   attached to answer unto Edwd Mitchell of a plea of Trespass on the Case —
        And whereupon the afd Pltf by Thomas Bowne his attorney Complains that where
   as the afd. Deft. the fifteenth day of July in the Year of our Lord Christ one thousand
   Seven hundred and Twenty at St. Pauls parish in Kent County within the Jurisdiction
