508 June Court 1720 for her appearance and Good behaviour be discharged. Elizabeth Mercy afd. Entered into Recogce. the time afd. in the Summ of Tenn pounds Sterling money to be Leveyed of her goods & Chattles Lands & Tenements Conditionally that if She did not make her prsonall Aprce: at this^Courtto Answer what Shall be objected agst her on his Lordships behalf and in the mean time to be of Good behaviour And no person appearing to Shew Cause to the Contrary why the Sd Recogce: Should not be discharged this Court here discharges the Same Recognizance Thomas Mercy & Peter Mercy Entered into Recognizance in in the Summ of five pounds Sterling each to be Leveyed on their Goods and Chatles Lands and Tenements Conditionally that if the afd. Elizabeth Mercy Should not make her personall appearance here and Answer as afd. & in the meantime to be of good behaviour. This Court here Discharges the Same Recognizances each of them. The Jurors for the Honble. the Ld proprietary & the Body of Kent County on their oath do present Elizabeth Marsey wife of a Certain Thomas Marsey late of Upper South Sassafrax hundred Planter the Sixth – day of December in the Year of our Lord Christ one and at diverse other times as well before as after thousand Seven hundred and Nineteen^ at upper South Sassafrax hun: dred afd. in Shrewsberry parish in Kent County within the Jurisdiction of this Court the fear of God before her Eyes not haveing but by the Insti: gation of the Devill Adultry did Committ with a Certain Robert Brown to the high displeasure of Almighty God to the Evil and pernicious Example of others agains the peace of our Sd Ld. propry his Rule and Dignity and agt. the form of an Act of Assembly of this province now in force in Such Case made and provided. Evid Emanuel Hurst DMacbride pr Dno. proprietarie On the Back of the preceeding Indictment was Endorst as folls vizt. Billa Vera Abram Redgrave foreman —– And the afd. Eliza. Marsey in her proper person Comes and defends the force and Injury when &c. And Says that She is not Guilty of the premisses afd. and for tryall puts herself upon the Country. Eliza. Mersey in pro: person And he who follows for the Ld Propry Says She is Guilty of the prmisses afd DMacbride pr ppry Thereupon Command was Given to the Sheriff of Kent County immediately that he^ Cause to Come twelve &c by whom &c. who neither &c. To Recognize &c. Because as well &c. of which Sd precept the Sd. Sherf. now here at this day vizt the 29th day of July anno Domi 1720. makes Return that he hath here ready – twelve &c. as by his precept he was Commanded. and now here afterwards vizt the day and year last mentioned Comes again as well the Sd Ld Propry: by |
