	June Court 1720 497 W^m Frisby of a plea that he render him the full and Just Sum of one thousand Nine hun: dred & thirty and two pounds of every way well qualified Tobacco in well Seasoned Cask of the value of twelve pounds Sterling money which from him he unjustly unjustly detaines &c. And whereupon the af^d. Plt^f by Thomas Bowne his Attorney Saith that whereas the af^d. Def^t. the twenty fourth day of July in the year of our Lord Christ One thousand Seven hundred and Seventeen at S^t Pauls parish in Kent County within the Jurisdiction of this Court by his Certain writing Obligatory which he The S^d Def^t. Sealed with his Seal and as his deed delivered here into Court brought the date where of is the Same day and year af^d. Granted himself holden & firmly bound Unto the af^d Plt^f. in the af^d. full & Just Sum of one thousand Nine hundred and thirty and two poun^ds: of every way well qualified Tobacco in well Seasoned Cask of the af^d. value of twelve pounds Sterling money to be paid unto the S^d Plt^f when thereunto required Yet the af^d. Def^t altho often required the af^d. Summ of one thousand Nine hundred & thirty and two pounds of Tobacco to the af^d plt^f hath not paid but that to him to ren: der or pay he the S^d Def^t hitherto hath denyed and still doth deney and unjustly detaine to the Damage of the af^d. plt^f three pounds of like money af^d. and there= upon he brings Suit &c. } Jn^o Doe TBowne p^r Qu^r pl^ds } R^d Roe And the S^d. James Rea in his proper person Comes and defends the force & Injury when &c. and prays leave to imparle hereunto untill next Court and he hath it and the Same day is given to the plt^f also. At which S^d. next Court viz^t. the 15^th. day of March anno Domⁱ 1719 Comes again as well the S^d plt^f. by his S^d Attorney as the S^d Def^t in his proper person and the S^d Def^t. prays further leave to imparle hereunto untill next Court and he hath it and the Same day is given to the plt^f also At which S^d next Court viz^t. the 21^st. day of June anno Domⁱ 1720 Comes again as well the S^d plt^f by his S^d Attorney as the S^d Def^t. in his proper person the S^d Def^t. haveing filed no plea to the accõn af^d. on which the Court gives Rule to the S^d Def^t. to file a plea to the accõn af^d by two a Clock in the afternoon the Same day last mentioned but no plea being put in according to the Rule af^d but the S^d Def^t. makes default whereby the S^d plt^f remains against the S^d Def^t. without further defence: Therefore it is Considered by the Justices here the 28^th. day of July anno Domⁱ 1720. that the S^d. William Frisby Recover again^^st the S^d. James Rea as well the Summ of one thousand Nine hundred and thirty two pounds of Tobacco his debt by occasion of the premisses af^d. as also the Summ of Two hundred and Seventeen pounds of Tobacco ————— by the Court here adjudged to him for his and Charges by him about this Suit in this behalfe Expended and the Def^t. in Mercy &c.
