   had Notice Nevertheless the af^d Def^t. his promises and assumptions af^d in form
   af^d. made in no wise regarding but plotting and fraudulently intending the
   S^d. plt^f in this behalfe Craftilly and Subtilly to defraude and deceive the af^d
   Summs of merchantable Tobacco in the whole amounting to one thousand –
                     merchantable
   forty pounds of^ Tobacco or any part thereof to the Same plt^f he hath not paid nor
   in any wise made Content altho to do the Same the af^d. Def^t. afterwards viz^t. the
   Seventeenth day of June in the year af^d. at the parish County and Jurisdicition
   af^d. and of afterwards by the Same plt^f was thereunto required But that to him
   to pay or Content hitherto hath deneyed and Still doth deney to the damage of
   him the S^d plt^f two thousand pounds of merchantable Tobacco and thereupon
   he brings Suit &c                                                                { Jn^o. Doe

      Whereupon at the prayer of the plt^f. the Def^t. is adjudged
   to give Special Bail And thereupon Roger Hicks of Kent County Planter
   present herein Court Comes and undertakes for the af^d. Thomas Evert that in
   Case the af^d. Peter Peterson Shall recover Judgement against the S^d Thomas
           in the accõn af^d.
   Evert^ or that he the S^d Thomas Evret Shall be therein Convict then the S^d
   Thomas Evret Shall pay the Condemnation of the Court thereon or deliver
   his body into the Custody of the Sheriff of Kent County in Satisfaction thereof
   or that he the S^d. Roger Hicks will do it for him
           And now at this Court viz^t the 28^th day of July anno Domⁱ 1720 the
   af^d. Def^t. here in Court present in his proper person Comes and defends the force
   and Injury when &c^a. And Says he cannot Gainsay the plt^f af^d. his acction
   So as af^d against him Brought nor can he Say but that the S^d plt^f ought
   to recover his damages by occasion of the premisses af^d. to the Summ of
   five hundred and twenty pounds of Tobacco with Cost of Suit against him
   which the S^d. plt^f doth not gain Say Therefore it is Considered by the Justices
   here on the 28^th day of July anno Domⁱ 1720 af^d. that the af^d. Peter Peter:
   Son Recover against the af^d Thomas Evret as well the Summ of five hund:
   red and twenty pounds of Tobacco his damages af^d. in form af^d. Confessed
   as also the Summ of two hundred and Seventy Nine —————
   pounds of Tobacco by the Court here adjudged to him for his Costs and Charges
   by him about his Suit in this behalf Laid out and expended and the Def^t
   in mercy &c.

   Return to the Court here on the Third Teusday in June Viz^t the 21^st
   day of the Said month Anno Domⁱ 1720 being the day of Return of the
                                                                                                            S^d
