   Same day is given the plt^f. also

DM. Peter Peterson –	\|	This being an Action of Trespass on the
a^t	\|	Case Commenced by the S^d Plt^f against the
Thomas Everitt	\|	S^d Def^t. and wherein the Sheriff of S^d County
		to whom the writt in the Said Action was

   directed makes Return to the Court here on the third Teusday in June viz^t.
   the 21^st day of the Same month being the day of Return of S^d Writt Endorst
   Cepi Corpus p^r Simon Wilmer Sher^f
   Whereupon the af^d. plt^f not liveing in this County David Macbride
   Attorney for the S^d plt^f. takes upon him the payment of the Costs in the af^d
   Accõn to the S^d Def^t. provided the S^d. Def^t. Shall appear and answer Unto the
   S^d Plt^f. in the action af^d. and the S^d plt^f. Shall be non Suit therein
   Kent County in Maryland Thomas Evret of Kent County planter was
   Attached to Answer unto Peter Peterson of a plea of Trespass on the Case
   And whereupon the af^d plt^f by David Macbride his Attorney Complains
   that whereas the af^d. Def^t. the twenty Seventh day of May in the Year of our
   Lord Christ one thousand Seven hundred and Eighteen at S^t pauls parish
   in Kent County within the Jurisdiction of this Court was Indebted to the af^d
   Plt^f in the Summ of five hundred and twenty pounds of merchantable
   Leafe Tobacco for twenty Six Bushells of Indian Corn at the Speciall
   Instance and request of the S^d Def^t. and to the proper Use and behoofe of the
   Said Def^t. before that time Sold and delivered and So thereof being indebted
   the af^d. Def^t. in Consideration thereof upon himself assumed and to the Same plt^f then
   and there faithfully promised that he the S^d Def^t. the af^d. Summ of five hundred &
   twenty pounds of merchantable Tobacco to the Same plt^f. when thereunto required
   would well and truely pay and Content. And that whereas also the af^d. Def^t. after
   wards viz^t. the twenty Seventh day of May in the Year af^d. at the parish County
   and Jurisdiction af^d. in Consideration that the af^d. plt^f at the Special Instance
   and Request of the af^d. Def^t. had Sold and delivered to the af^d Def^t. and to the pro:
   per Use and behoofe of the S^d Def^t. twenty Six Bushells of Indian Corn (in
   an account hereunto annexed particularly Sett forth) upon him Self as:
   Sumed and to the Same plt^f. then and there faithfully promised that he the S^d Def^t.
   So much merchantable Tobacco as the af^d. Twenty Six Bushels of Indian Corn
   Sold and Delivered as af^d. at the time of the Sale and Delivery of the Same
   were reasonably worth to the Same plt^f. when thereto afterwards he Should be
   required would well and truely pay and Content. And the af^d. plt^f indeed Saith
   that the af^d twenty Six Bushells of Indian Corn at the af^d time of their Sale &
   delivery at the parish County & Jurisdiction af^d. were reasonably worth and
   amounted unto five hundred and twenty pounds of merchantable Tobacco
   in manner as in the Said account Sett forth of which the Said Def^t then & there
                                                                                                                    had
