   456                                 March Court 1719
   or pay hitherto hath denyed and Still doth deny and unjustly —
   detains to the damage of the Said Plt. Sixty pounds Sterl^g and thereupon
   he brings Suite &c^a. And hereinto Court brings the Lett^rs. of Administration
   which Testify &c^a                 D Macbride p^r Quer^r plds Jn^o Doe & R^d Roe
   whereupon at the prayer of the plt by his Said Att^ry the Said Deft
   is adjudged to give Special baile to the Accõn afd And that the —
   Sherf of Said County keep the Said Deft. in Safe Custody untill
   he Shall give Special baile as afd and Rule is given to the Said
   Deft to plead and that he put in a plea to the afd Accon Thirty days
   after the Court adjourns otherwise Judgment to be rendered in the
   afd Accõn ag^st. the Said Deft for want of a plea
     Att which Said next Court to wit the 21^st day of March Anno Domⁱ
   1719 comes again as well the Said Plt by his Said att^ry as the
   Said Deft in Custody of the Sherf of Said County And no plea
   being put into the afd Accon by the afd Deft according to the Rule
   afd but makes default whereby the Said Plt remains ag^st the
   Said Deft. without Defence Therefore it is Considered by the
   Justices here the 21< st day of March Anno Domⁱ 1719 afd That the
   Said Richard Cole Adm^r as afd Recover against the Said John Jones
   as well the Sume of Three Thousand pounds of Tobacco his Debt afd
   as also the Sume of Three hundred Ninety five pounds of Tobacco
   by the Court here adjudged to him for his Cost and Charges about his –
   Suite in this behalfe laid out and expended And the Deft in mercy &c^a

   the force and Injury when &c^a. and Prays leave to imparle hereunto untill
   next Court which is granted And the Same day is given the Plt. also
   Att which Said next Court to wit the 21^st. day of March Anno Domⁱ 1719 comes
   again as well the Sd Plt by Thomas Bowne his att^ry As the Said Deft by
   his Said Att^ry And the Said Plt having not fild his Declⁿ according to
   the Rules of this Court which ~~was~~ is thirty five days after appearance entered
   and no Declⁿ put in by the Said Plt or his att^ry untill the rule was out on
   which the Said Deft by his att^ry puts in A Nerecipiatur not to receive
