   Gilbert Higginson Recover against the said Deft William Borross
   as well the Sume of Four Thousand four hundred & forty Six pounds of—– Tobacco
   Debt afd as also the Sume of Three hundred Seventy five pounds of
   Tobacco by the Court here adjudged to him for his Cost and Charge[s]
   about his Suite in this behalfe laid out and expended and the
   Deft in mercy &ca.

Richard Cole Administrator of
   all the Goods and Chatles Rights and Credits which were of Renatus Smith
   who dyed Intestate (as is Said) of a plea that he render unto him the
   Just and full Sum of Three Thousand pounds of Good Sound Merchantable
   Leafe Tobacco with Cask to Contain the Same of the value of thirty —
   pounds Sterling which from him he unjustly detaines &ca.
      and Whereupon the afd Plt by David Macbride his Attry Saith
   that whereas the afd Deft. the twenty Seventh day of November in
   the year of our Lord Christ one Thousand Seven hundred and Sixteen
   at St. Pauls Parish in Kent County within the Jurisdiciõn of this Court
   by his Certain Bill obligatory which he the Said Deft Sealed with
   his Seale and as his deed delivered hereinto Court brought the date
   whereof is the Same day and Year above mentioned bound himselfe
   his heirs Execrs. and Administrators to pay or Cause to bepaid unto the
   Said Renatus Smith the afd Just and full Sume of Three Thousand pounds
   of Good Sound Merchantable Leafe Tobacco with Cask to Contain the Same
   of the afd value of thirty pounds Sterling at or upon the tenth day of Janry
   next Ensuing the date of the Said Bill Obligatory Nevertheless the afd Deft
   the afd Just and full Sum of Three Thousand pounds of Good Sound Merchble
   Leafe Tobacco with Cask to Contain the Same of the afd value of thirty
   pounds Sterling to the afd Renatus Smith in his life time nor to the
   afd Richard Cole Since the death of the afd Renatus Smith altho’ often
   required by ye afd Renatus in his life time and by the afd Richd. Since
   the death of the afd Renatus viz the Seventh day of August in the Year
   of our Lord Christ one Thousand Seven hundred and Nineteen and
   often afterward at the Parish County and Jurisdiciõn afd he the Sd
   Deft hath not rendered nor paid but that to the Said^pltto render
