   454                               March Court 1719
   pounds Sterling money which he unjustly detains &ca.
      and Whereupon the afd Plt. by Thomas Bowne his attry Saith
   that Whereas the afd Deft the Sixteenth day of October in the
   year of our Lord Christ one Thousand Seven hundred & Eighteen
   at St. Pauls Parish in Kent County within the Jurisdiciõn of
   this Court By his Certain Bill obligatory which he the Said –
   Deft Sealed with his Seale & as his deed Delivered hereinto —
   Brought the date whereof is the Same day & year afd Bound
   himselfe to pay to the afd Plt. the afd full and Just Sume
   of four thousand four hundred & forty Six pounds of good Sound
   Clean dry Tobacco Clear of all Ground Leafe and trash in Casque
   of the afd value of forty four pounds Sterlg money Convenient
   in the Said County at or before the tenth day of November next
   ensuing the date of the Said Bill Obligatory Nevertheless the
   afd Deft altho’ often required the afd Sume of four Thousand
   four hundred & forty Six pounds to the Said Plt. hath not paid
   But that to him to render or pay hitherto hath denied & Still
   doth denie and unjustly detaine to the damage of the Said Plt.
   Eight Thousand Eighty hundred & ninety two pounds of Like
   Tobacco and Thereupon he brings Sute &ca. Bowne pr Querr Plds Jno Doe Rd Roe
   and the afd Deft by David Macbride his attry comes and —
   defends the force and injury when &ca. And prays leave to imparle
   hereunto untill next Court and he hath it And the Same day
   is given the Plt also —–
      Att which Said next Court to wit the 17th day of November Anno
   Domi 1719 comes again as well the Said Plt by his Attry afd As
   the Said Deft. by his Said Attry. and the Said cause is Continued —
   untill the then next Court
        Att which Said next Court to wit the 15th day of March Anno Dom
   1719 comes again as well the Said Plt by his attry afd as also the Sd
   Deft by his Said Attry. and no plea being put into the Said Accõn This
   Court gives rule to the Said Deft. to file A plea by the 17th day of March
   afd otherwise Judgment to be rendered in the Same accõn agst. the afd .
   Deft. and now at this day to wit the 21st day of March Anno Domi 1719
   the Said Deft by his attry afd having not pleaded to the afd Accon but.
   makes default whereby the Said Plt may remain against the Said –
   Deft without further defence Therefore it is Considered by the Justices
   here to wit the 21st day of March Anno Domi 1719 afd That the Said
