448 March Court 1719 his attry comes and defends the force and injury when &ca And prays leave to imparle hereunto untill next Court and he hath it And the Same day is given the Plt also Att which Said next Court to wit the 18th day of August Anno Domi 1719 comes again as well the Said Plt by his attry afd as the Said Garni: :she by his Said attry and the Said Cause was Continued untill the next Court. Att which Said next Court to wit the 17th day of November Anno Domi 1719 comes again as well the Said Plt by his Said Attry as the Sd Garnishe by his afd Attry and the Said Cause was Continued untill the next Court Att which Said next Court to wit the 21st. day of March Anno Domi 1719 comes again as well the Said Plt by Thomas Bowne his attry As the Said Garnishe by his Said Attry and the afd Michael by David Macbride his attry Comes & defends the force and Injury when &ca and Saith that the afd William Condemnation of the afd Sum of two pounds eight Shillings and three pence Sterg and the Sume of Six hundred pounds of Tobacco attached in his the Said Michaels hands in the return of his the Sd Williams writ of Attachment mentioned ought not to have, because he Saith that at ye time of ye Sd Plts laying of the Sd Plts Sd writ of Attachment as afd in the hands of the Said Michael Pursuant to the return of ye Sd writ of Attachment had not in his hands Custody or possession any of the Goods or Chattells of the Said Richard Lee whereby he could Satisfy unto the Said William the Sd Summ of two pounds eight Shillings and three pence Sterg and ye Sd Summ of Six hundred pounds of Tobo So as afd Attached in his hands or Custody as afd And of this he putts himselfe upon the Country D Macbride pr Garnise and the Plt in like manner TBowne pr Querr Thereupon Command is given to the Sherf of Kent County that he Immediately cause to come here twelve &ca. By whom &ca. who neither &ca. to Recognize &ca. Because as well &ca of which Said precept the said Sherf to wit Simon Wilmer Gent now here at this day to wit the 21st. day of March Anno Domi 1719 makes return that he hath here ready twelve &ca. As by his precept he was Commanded and now here afterwards to wit the day and Year last mentioned comes again as well the Said Plt by his last Said attry as the Said Garnishe by his attry afd and the Jurors of that Jury being Impannelled who being called Likewise came to wit Thomas Piner Robert Meeks John Ashley Robert Mansill William Brown Richard West John Rollinson George Reed William Graves William Blackiston Arthur Foreman John Reed who being duely Elected tryed and Sworn to Say the truth in the premises upon their Oath do Say they find for the Plt And that the Garnishe at the time of the Lay |
