446 March Court 1719 of the Sherf of Said County The Same cause was further Continued untill the then next Court. Att which Said next Court to wit the 17th day of November Anno Domi 1719 comes again as well the Said Plt by his attry afd As the Said Deft in Custody of the Sherf of Said County and the Same cause was further Continued untill the then next Court Att which Said next Court to wit the 21st. day of March Anno Domi 1719 comes again as well the Said Plt by his attry afd As the Said Deft. in Custody of the Sherf of Said County and the Same cause Standing for tryall And the Said John Jones by Ebenezer Cooke his attorney Comes & defends the force & injury &ca. And Confesses his promise & Assumption of the five hundred pounds of Tobacco in forme afd but Saith that he hath account of his own against the Said Plt Since the time of the Said assumption amounting to the Sume of five five hundred & Eight pounds of Tobacco which he is ready to procure &ca. Wherefore he prays allowance of the Same &ca. yet Notwithstanding the Said Deft by Ebenezer Cooke his attry relinquishes the Averment afd by him above pretended And defends the force and Injury when &ca. And Says that the Deft afd hath not informed him what to plead therefore he cannot prosecute the plea afd By which the Said Plt remains against the Said Deft without further defence Therefore it is Considered by the Justices here the 21st day of March Anno Domi 1719 afd That the Said Gilbert Falconar Recover against the Said Deft John Jones as well the Sume of Seven hundred and fifty pounds of Tobacco Damages by Occation of the premises afd as also the Sume of Two hundred Eighty four pounds of Tobacco by the Court here adjudged to him for his Costs and Charges about his Suite in this behalfe laid out. and Expended And the Deft in mercy &ca.
