    438                                 March Court 1719
   Said Deft the afd Sume of Three hundred Seventy Six pounds of
   Merchantable Tobacco unto the Said Plt when thereunto required
   would well & truly pay & Content And that whereas also the afd
   Deft afterwards vizt. the fifth day of March in the year of our
   Lord Christ one Thousand Seven hundred & fifteen at the parish
   County & Jurisdiciõn afd was Indebted unto the afd Plt in the
   Sume of two hundred & Eighty pounds of Merchantable Tobacco
   for Execution & other fees then & there last mentioned due from
   the Said Deft to the afd Plt. the Same Plt then and there last
   mentioned being Sherrife of Kent County afd and So thereof being
   Indebted the afd Deft In Consideration thereof afterwards vizt–
   the afd fifth day of march in the Year of our Lord Christ one
   thousand Seven hundred and fifteen at the Parish County & Jurisdiciõn
   afd upon himselfe assumed And to the Said Plt then & there last
   mentioned faithfully assumed And to the Said Plt then & there last
   mentioned faithfully promised that he the Said Deft the afd Sume
   of two hundred & Eighty pounds of Merchantable Tobacco would well
   & truly pay & Content And that Whereas also the afd Deft afterwards
   vizt. the twenty fifth day of January in the Year of our Lord Christ one
   Thousand Seven hundred and Sixteen at the Parish County & Jurisdiciõn
   afd was Indebted unto the afd Plt. in the Sume of Eight hundred and
   twenty five pounds of Merchantable Tobacco for one Levey of one
   taxable and Clark fees then and there last mentioned due from
   the Said Deft to the Said Plt. the Same Plt. then and there last
   mentioned being Sherf of Kent Coun afd and So thereof being Indebted
   the afd Deft. In Consideration thereof afterwards vizt. the afd twenty
   fifth day of January in the of our Lord Christ one Thousand Seven
   hundred and Sixteen at the Parish County & Jurisdiciõn afd upon
   himselfe assumed and to the Said Plt. then and there last mentioned
   faithfully promised that he the Said Deft the afd Sume of Eight
   hundred and twenty five pounds of^good MerchantableTobacco unto the Said Plt when
   thereunto required would well and truly Pay & Content Nevertheless the
   afd Deft. his Severall promises & assumptions afd In forme afd made as
   to the afd Severall Sumes of Tobacco amounting in the whole to one –
   Thousand Six hundred and Seventy Seven pounds of Merchantable Tobacco
   he hath not minded nor in any ways kept but altho’ he the Said Deft
   hath paid & Satisfied to him the Said Plt. to the value of five hundred
   pounds of Tobacco of the afd Sume of one thousand Six hundred and
   Seventy Seven pounds of Merchantable Tobacco part Yet the afd Deft
