March Court 1719 433 then Justices of the right Honble. the Lord proprietarie for the Said Court in the Said Court in the County and Jurisdiciõn afd Judicially Setting taken was legally proved and appeared due to the Said Plt. as by the Records of the Same Court here remaining fully appears and of which the Said Deft the twenty third day of March in the Year afd at the Parish County and Jurisdiciõn afd had Notice and that Whereas also the afd Deft. afterwards vizt. the afd — Twenty Second day of March in the Year afd at the Parish County & Jurisdicõn afd was indebted unto the afd Plt. in the Sume of Two Thousand five — hundred and Eighty pounds of Tobacco for diverse Services by the afd Plt for the Said Deft. and to the proper use and behoofe of the Said Deft. before that time at the parish County and Jurisdiciõn afd done and performed and the Sume of one hundred and Seventy pounds of Tobacco the Cost of a Certain Suite and So thereof being Indebted the afd Deft In Consideration thereof afterwards viz the afd last mentioned Twenty Second day of March in the Year afd at the Parish County and Jurisdiciõn afd upon himselfe Assumed and to the Said Plt then and there last mentioned faithfully Promised that he the Said Deft the afd Sume of Two Thousand five hundred and Eighty pounds of Tobacco and one hundred and Seventy pounds of Tobacco unto the Said Plt when thereunto required would well and truely pay and Content Nevertheless the afd Deft his Severall promises and assumptions afd in forme afd made little minding but plotting and fraudulently Intending him the Said Plt in that behalfe Craftily and Subtilly to deceive and defraud the afd Severall Sums of Tobacco which in the whole amounts unto the Sume of Eight Thousand one hundred and - Seventy Eight pounds of Tobacco to the Said Plt altho afterwards vizt the —– twenty third day of March in the Year afd and often after at the parish County and Jurisdiciõn afd he the Said Deft by the afd Plt. was thereunto required – hath not paid nor made Content for the Same But that to pay or make Content hitherto hath denyed and Still doth deny to the damage of him the Said Plt Sixteen Thousand pounds of Tobacco & thereupon he brings Suite &ca. TBowne pr Querr Plds Jno Doe & Rd Roe and the afd Deft by Johnson his attry comes and defends the force and Injury when &ca. And Prays leave to imparle hereunto untill next Court and he hath it And the Same day is given the Plt. also Att which Said Court to wit the 18th day of August Anno Domi 1719 the afd Accõn being moved by a Habeas Corpus to the Proventiall Court but for as much as a Procedendo from the Said Court to orders the Justices of our afd County Court to — proceed in the premises afd against the Said Richard Smithers as if the Said writ of Habeas Corpus had never Yet Issued. And now at our Said County to wit the Same day and Year last mentioned came The afd Plt by his attry afd as the Said Deft by his attry. and as before defends the force and injury when &ca. and prays further leave to imparle hereunto untill next Court and he hath it And the Same day is given the Plt also at |
