420 March Court 1719 afd being found feloniously did Steal take and bear away against the Peace of our Said Lord Proprietary his rule and dignity and against the form of an Act of Assembly of this Province now in force in Such Case made and Provided &ca. D Macbride pr Dnõ Proprie Evidce. Edward Beck Cunstable on the back of the preceeding bill was Endorsed as folls vizt. Billa Vera pr William Crowe foreman and now at this Court to wit the 17th day of March Anno Domi 1719 Comes the afd Henry Monk in Proper person to the barr And to the afd Indictment Pleads not guilty And for tryall puts himselfe on God and his Country Henry Munk in proper person and he who follows for the Lord Proprietor Says he is guilty D Macbride pr Dnõ propry. Thereupon Command is given to the Sherf of Kent County that he immediately cause to come here twelve &ca. By whom &ca. who neither &ca. To Recognize &ca. Because as well &ca. of which Said precept the Said Sherf to wit Simon Wilmer Gent. now here at this day to wit the 17th day of March Anno Domi 1719 makes returne that he hath here ready twelve &ca. as by his precept he was Commanded And now here afterwards to wit the day & year last mentioned Comes again as well the Sd Ld Ship by his Clarke of Indictments afd as the Said Prisonr. at the barr and the Jurors of that Jury being Impannelled who being Called Likewise came to wit Thomas Piner George Reed Robert Meeks John Ashley Robert Mansfield William Brown Richd West John Rollinson William Graves William Blackiston Arthr. Foreman John Reed who being duely Elected tryd & Sworn to Say the truth in the Premises upon their Oath do Say that the Said Henry Monk is guilty as he Stands Indicted and the afd Lord Proprietary by his Clarke of Indictmts. afd prays Judgment on the Verdict of the Jurors afd Therefore it is Considered by the Justices here to wit the 17th day of March Anno Domi 1719 afd That the Said Henry Monnk Stand one hour in the Pillory and to be whypt on his bare back and have fifteen Lashes till the blood appear and that the afd Goods and Chattells are adjudged to the value of one pound Nine Shillings and one penny Sterlg money and that the afd Nathaniel Hynson have the afd Goods and Chattells be restored to the Said Nathaniel Hynson And also the Said Henry Monnk pay four fold of the afd Goods & Chattells Amounting to five pounds Sixteen Shills. and four pence Sterlg money unto the afd Nathaniel Hynson and also pay the SUme of ac: |
