March Court 1719 415 of our Lord Christ one thousand Seven hundred and nineteen at the hundred afd in Shrewsberry parish in Kent County within ye: Jurisdiction of this Court and within a Certain district where William Burross then was for amending and repairing the publick and Main Roads Lawfully Appointed Overseer then and there being an Inhabitant and taxable and being by the Sd: Overseer Seasonably and duely Warned to Send All his Male taxables to repair and amend the afd Roads the Said John did then and there obstinately and Contemtuously refuse to Send any male taxable to work and Labour in mending and repairing a certain Publick main Road leading from Cyprus branch to John Ellis’s within the district afd the Said Roads then being decayed and out of Repair against the peace of our Said Lord Propry. his Rule and dignity and against the form of an Act of Assembly of this Province now in force in Such Case made & provided Evide. William Burross overseer D Macbride pr Dnõ Proprie on the back of the preceeding bill was Endorsed as folls vizt. Billa Vera pr William Crow foreman and now at the Said Court to wit the 16th day of March Anno Domi 1719 comes The afd John Jones and defends the force and injury when &ca. And Says that he Cannot gainsay the bill of Indictment afd So as afd against him nor but that he did omitt coming to help Clear the Road when warned by the Said overseer and Thereupon he Submitts to the Court Therefore it is Consider: :ed by the Justices here the 16th day of March Anno Domi 1719 afd that the Said John Jones be find the Sume of one hundred pounds of Tobacco for his offence afd in forme afd Confessed according to Act of Assembly in Such Case made and provided &ca. and also pay the Sume of Two hundred twenty five pounds of Tobacco Costs accrueing on the premises afd to the officers of this Court Jams Smith Clk
to wit the 15th day of the Same month Anno Domi 1719 being ye day of return Endorst Summoned pr Simon Wilmer and the Sd Deft aprs. and there being not Sufficient mattr in the bill to Support the Same The Clarke of Indictmts. by the Consent of the Court Enters A Noli prosequi and that the Same be no farther prosecuted |
