third tuesday in March to wit the 15th day of the Same month Anno Domi 1719 being the day of return Endorst Summoned pr Simon Wilmer Sherf
within the Jurisdiciõn of this Court and within a Certain district where William Burrose then was for repairing and amending the Publick main Roads Lawfully appointed overseer then and there being an Inhabitant and Taxable and being by the Said overseer Seasonably and duely warned to Send all his Male Taxables to Labour and work in mending and repairing the afd Roads the Said John did then and there obstinately and Contemtuously Refuse to Send any taxable Man to work and Labour in mending a Certain Publick main Rain Road leading from Cypras Branch to John Ellis’s within the district afd the Said Roads then and there being decayed and out of repair against the Peace of our Said Lord Propry his rule and dignity and against the form of an Act of assembly of this province now in force in Such case made & provided D Macbride pr Dnõo Proprie Evidce. William Burross oversear. on the back of the preceeding bill was Endorst as folls vizt. Billa Vera pr And now at this Court to wit the 16th day of March Anno Domi 1719 comes the afd Deft. and defends the force and injury when &ca. and Says that he cannot gainsay the bill of Indictment afd So as afd against him Thereupon he Submits to the Court on the Same Therefore it is Considered by the Justices here on the 16th day of March Anno Domi 1719 afd That the Said John Waste be Fin’d the Sume of one hundred pounds of Tobacco for his omitting to Clear the Roads as afd according to Act of Assembly in Such Case made and Provided and also pay the Sume of Two hundred Sixty five pounds of Tobacco Cost accruing on the premises afd to the officers of this Court Jams Smith Clk |
