   deceive & defraud the afd Summs of Tobacco in the whole amounting to
   Seven Thousand and Seventy pounds of Merchantable Tobacco or any
   part thereof to the Said Plt. he hath not paid but that to him to pay
   the afd Deft afterwards vizt. the fifteenth day of August in the Year afd
   at the parish County & Jurisdiciõn afd & often afterwards by the Said
   Plt. was often required But that to him to pay hitherto hath
   refused & Still doth refuse to the damage of Said Plt. Nine Thousand
   pounds of^merchantableTobacco & thereupon he brings Suite &ca

                                                             Errors Excepted pr James Cruckshank
   There being a Copy of a Short note made and Sent with the writ Issued
   in the Said Accõn Expressing the Plts. cause of Accõn in the plea afd
   whereupon the Said Plt. by his attry afd Prays that for as much as he
   hath Complyd with the Law in order to an Attachment he may have
   Judgment against the Said Deft: for his damages by Occation of the
   premises afd by way of Attachment according to Act of assembly —
   Whereupon for that it Seems to the Court here the day & Year
   last mentioned that the Said James Cruckshank hath Complyed with
   the law as alledged Therefore it is Considered by the Justices here the
   16th: day of March Anno Domi 1719 That the Said James Crucksank Recover
   against the Said Murtough Mahony as well the Sume of Three Thousand
   five hundred thirty five pounds Tobacco his Damages afd as all Costs
   and Charges by the Said James Cruckshank laid out & Expended about
   his Suite by way of Attachment agst. the Goods Chattells Rights and Creditts
   of the Said Murtough Mahony according to Act of Assembly in that Case
   made & provided
