   Kent County | Murtough Mahony of Kent County Planter was
             in | Ss    attached to answer unto James Cruckshanks of a
    Maryland     | plea of Trespass on ye Case
   and Whereupon the afd Plt by David Macbride his attry.
   Complains that whereas the afd Deft. the fourteenth day of Augst.
   in the Year of our Lord Christ one Thousand within the Jurisdiciõn
   of this Court was Indebted unto the afd Plt in the Sume of Three
   Thousand five hundred and thirty five pounds of Merchantable
   Tobacco for diverse wares Goods and Merchandizes by the afd Plt to
   the afd Deft. and to the proper use & behoofe of the Said Deft before
   that time Sold and delivered & Sum money lent as in Accot. hereunto
   annexed Sett forth and So thereof being Indebted the afd Deft
   afterwards vizt. the fourteenth day of August in the Year afd at
   the Parish County & Jurisdiciõn afd In Consideration thereof upon
   himselfe Assumed and to the Said Plt then and there faithfully
   promised that he the Said Deft the afd Sume of Three Thousand
   five hundred & Thirty five pounds of Merchantable Tobacco to the
   Said Plt when thereunto afterwards he Should be Required would
   well & truely pay & Content and that Whereas the afd Deft afterwds
   viz the fourteenth day of August in the Year afd at the parish
   County & Jurisdiciõn afd had Accounted together with the Said
   Plt for diverse Sums of Tobacco by the Said Deft from the Said
   Plt before that time due and unpaid and upon that Accounting the
   Said Deft was found in arrearage to the Said Plt the Sume of Three
   Thousand five hundred and thirty five pounds of Merchantable Tobacco
   and So in arrearage being found the afd Deft afterwards vizt the fourteenth
   day of August in the Year afd at the parish County & Jurisdiciõn afd
   In Consideration thereof upon himselfe assumed and to the Said Plt
   then and there faithfully promised that he the Said Deft the afd Sume
   of three Thousand five hundred and thirty five pounds of Merchble
   Tobacco to the Said Plt when thereunto afterwards he Should be
   required would well & truely pay & Content Nevertheless the afd
   Deft his promises & assumptions afd in form afd made in no wise
   minding or regarding but plotting & fraudulently intending the
   Said Plt in this behalfe Craftily and Cunningly to deceive and —
