    396                                  March Court 1719
   and the Said Deft by Thomas Bowne his attry aprs to Sd Accon but
   now at this Court to wit the 15th. day of March Anno Domi 1719 comes
   the afd Deft in his proper person and defends the force and Injury
   when &ca. and Says that he cannot gainsay the Plt his accon afd So
   as afd against him brought nor can he Say but that the Said Plt
   ought to Recover his Debt by Occation of the premises afd with
   Cost of Suite which the Said Plt does not gainsay Therefore it is
   Considered by the Justices here the 15th. day of March Anno Domi 1719
   afd That the Said Henry Lowe Recover against the Said Nathaniel
   Pearce as well the Sume of Two Thousand three hundred and
   twenty Eight pounds of Tobacco his debt afd in forme afd Confessed
   as also the Sume of Three hundred Eighty Three pounds of Tobo.
   by the Court here adjudged to him for his Costs and charges about his
   Suite in this behalfe laid out and Expended And the Deft in mercy
   &ca

   D:M: William Hunt | This being an accon of Debt Commenced by the

& Company   | Plts agst. the Deft And wherein the Sherf of Kent

          at | County to whom the writ in the Same accõn was

Jacob Bell —   | directed makes return thereof to the Court here on



the third Tuesday in March to wit the 15th day of
   the Same month Anno Domi 1719 being the day of return Endorst Cepi
   Corpus pr me Simon Wilmer Sherf
     Whereupon at the Prayer of the Plts by David Macbride their
   attry the Deft was adjudged to give Special baile to the accõn
   afd And that he be keept in Safe Custody by the Sherf of Said County
   untill he Shall give Special baile as afd
   The afd Plts being not Inhabitants of this County Michael Miller of
   Kent County Gent. present here in Court takes upon himselfe the paymt.
   of the Deft all his Cost in the afd Accon if the Plt be non Suited
   Thereupon John Rollinson and John Magner of Kent County Planters
   present here in Court undertakes and either of them undertake Joyntly
   and Severally for the Said Jacob Bell that in Case the Said William Hunt
   & Company Shall Recover Judgment in the plea afd against the Said Jacob
   Bell or that he the Said Jacob Bell Shall be therein Convict that then he
   the Said Jacob Bell Shall pay the Condemnation of the Court thereupon or
   render his body to the Custody of the Sherf of Said County in Satisfaccõn
   thereof or that they the Said John Rollinson and John Magner or one
   of them will do it for him
