                                         March Court 1719                                      395 
   a Copy of the Decln with the writ in the Said Accon and wherein the Sherf
   of Kent County to whom the writ in the Same accõn was directed makes
   return thereof to the Court here on the third tuesday in March to wit the
   fifteenth day of the Same month Anno Domi 1719 makes return thereof —
   Endorst Cepi Corpus Copy of the Decln Served in time pr me Simon Wilmer Shrf
    Whereupon at the Prayer of the Plt by Ebenezr Cooke his attry the Deft
   is adjudged to give Special baile to the accon afd And that the Sherf of
   Said County keep the Said Deft in Safe Custody untill he Shall give Specil
   baile Thereupon Mathew Howard of Kent County Planter present here
   in Court undertakes for the Said Nathaniel Pearce that in Case the Said
   Henry Lowe Shall Recover Judgment in the Plea afd agst. the Said Nathl.
   Pearce or that he the Said Nathaniel Pearce Shall be therein Convict
   that then he the Said Nathaniel Pearce Shall pay the Condemnation
   of the Court thereupon or render his body to the Custody of the Sherf of
   Kent County in Satisfaccõn thereof or that the Said Mathew Howard –
   will do it for him
   Kent County Ss: Natthaniell Pearce late of Kent County Planter als dicts —–

Natthaniell Pearce of the Same County Planter was Summoned to –

answer unto Henry Lowe Merchant of a plea that he render to him the

full & just Sume of two Thousand Three hundred twenty Eight pounds of

Sound Tobacco in Cask to Containe the Same of the value of twenty three

pounds Sterling which from him he unjustly detains &ca
   and Whereupon the afd Plt by Ebenezr Cooke his attry Saith that
   whereas the afd Deft the Eighteenth day of November in the Year of
   our Lord Christ Seventeen hundred & Nineteen at St. Pauls Parish in
   Kent County within the Jurisdiccon of this Court by his certain bill
   obligatory which he the Said Deft Sealed with his Seale and as his —
   deed delivered herein to Court brought the date whereof is the Same
   day & year above mentioned bound himselfe his Heirs &xrs. & Admrs. to
   pay unto the Said Henry Lowe the afd full & just Sume of two Thousand
   three hundred twenty Eight pounds of Sound Tobacco in Cask to Containe
   the Same of the afd value of twenty Three pounds Sterling Nevertheless
   the Said Deft the Said full & just Sume of two Thousand Three hundred –
   twenty eight pounds of Sound Tobacco in Caske to Containe the Same of
   the value afd altho’ often required by the Said Henry at the Parish County
   & Jurisdiccõn afd he the Said Deft hath not rendered or paid but that
   to the Said Plt. to render or pay hitherto hath denyed & Still doth deny
   & unjustly detains to the damage of Sd Plt twenty pounds Sterlg
   & therefore he brings Sute &ca.
