   392                                March Court 1719
   the 15th day of the Same month Anno Domi 1719 being the day of
   return of Said writ thereof Endorst Non Est Inventus Copy of the
   Declaration left at the last place of the Defts abode in this County
   pr Simon Wilmer Sherf.

of Trespass on the Case and Whereupon the afd —
   Plt by Thomas Bowne his attry Complaines that whereas the afd Deft
   the Seventh day of May in the Year of our Lord Christ one thousand
   Seven hundred & Nineteen at St. Pauls Parish in Kent County within
   the Jurisdiccõn of this Court was Indebted to the afd Plt. in the Sume of
   four pounds fourteen Shillings & Six pence Currant money of Maryld
   and Six hundred pounds of Merchantable Tobacco for diverse goods
   wares and Merchandizes then and there Sold and delivered by the afd
   Plt to the afd Deft & to the Proper use and behoofe of the afd Deft
   and So thereof being Indebted the afd Plt afterwards viz the day and
   Year afd at the Parish County & Jurisdiccõn afd upon himselfe assumed
   and to the Said Plt. then and there last menconed faithfully promised
   that he the Said Deft the afd Sume of four pounds fourteen Shills.
   & Six pence Currant money afd and Six hundred pounds of Merchantble
   Tobacco to the afd Plt. when thereunto Required would well & truly pay
   and Content Nevertheless the afd Deft his promise and assumption afd
   in forme afd made as to the afd Sume of four pounds fourteen Shills &
   Six pence and Six hundred pounds of Merchantable Tobacco little
   regarding But plotting and fraudulently Intending him the Said Plt
   in that behalfe Craftily to deceive and defraud the afd Sume of
   four pounds fourteen Shillings & Six pence Currant money afd and
   the afd Sume of Six hundred pounds of Merchantable Tobacco to
   the afd Plt. hath not paid nor made Content Therefore altho’ to pay the
   Same the Said Deft afterwards vizt. the Tenth day of May in the Year
   afd at the parish County & Jurisdicion afd By the afd Plt was thereunto
   Required But that to him to pay or Content the afd Deft hitherto
   hath denied and Still doth denie to the damage of the afd Plt twelve
   hundred pounds of like tobacco afd and Thereupon he brings Sute &ca.
