                                           March Court 1719                                                 387  
   wherein the Sherf of Kent County to whom the writ in the Same accon was directed
   makes return thereof to the Court here on the third Tuesday in March to wit the
   15th day of the Same month Anno Domi 1719 being the day of return of Said writ
   Endorst Cepi Corpus Copy of the Decln Served in time pr me Simon Wilmer Sherf
   Whereupon at the prayer of the Plt by Thomas Bowne his attry the
   Deft is adjudged to give Special baile to the afd Accon and that the Sd
   Deft be kept in Safe Custody by the Sherf of Said County untill he Shall
   give Special baile as afd But the Said Plt in his proper person comes
   into Court the Same day last mentioned and releases the Said Deft. from
   the Committment for Special Baile as afd
   Kent County | Garrett Clozey of Kent County Planter als Dics Garrett Clozey
     Maryland    | Ss   of Kent Coty. oversr. was Summoned to answer unto Henry


Lowe of a plea that he render him the full & Just Sume of
   Six thousand Seven hundred and forty pounds of Tobacco of the value of
   Sixty pounds Sterling money which form him he unjustly Detaines and
   whereupon the afd Plt. by Thomas Bowne his attry Saith that —–
   whereas the afd Deft the Second day of September in the Year of our
   Lord Christ one Thousand Seven hundred and Eighteen at S . Pauls Parish
   in Kent County within the Jurisdiciõn of this Court by his Certaine writing
   Obligatory which he the Said Deft Sealed with his Seale and as his
   deed delivered here into Court brought the date whereof is the Same
   day & Year afd Granted himselfe holden & firmly bound unto the –
   afd Plt in the afd full & Just Sume of Six Thousand Seven hundred and
   forty pounds of Tobacco of the afd value of Sixty pounds Sterling money
   to be paid unto the afd Plt when thereunto Required Yet the afd Deft
   altho’ often required the afd Sume of Six Thousand Seven hundred &
   forty pounds of Tobacco to the Said Plt hath not paid But that to him
   to render or pay he the Said Deft hitherto hath denied and Still doth denie
   and unjustly detaine to the damage of the afd Plt. twenty pounds Sterling
   money afd and thereupon he brings Sute &ca.
                                                        Bowne pr Querr Plds Jno Doe Rd Roe
   and now at this Court to wit the 15th day of March Anno Domi 1719 the afd
   Deft comes and defends the force and Injury when &ca. And Says that he
   cannot gainsay the Plt his accõn afd So as afd against him brought nor
   but that the Said Plt. ought to recover his Debt afd by Occation of
   the premises afd and Cost of Suite which the Said Plt does not gainsay –
   Therefore it is Considered by the Justices here the 15th day of March
   Anno Domi 1719 afd That the Said Henry Lowe Recover against the
   Said Garrett Clossey as well the Sume of Six Thousand Seven hundred
