March Court 1719 383 delivered hereinto Court brought the date whereof is the Same day and Year afd bound himselfe in the afd Sum of Six hundred pounds of good Sound Merchantable Leafe Tobacco of the afd value of Six pounds Sterling money to be paid unto the afd Plt on or at the tenth day of October next ensuing the date of the Said bill Obligatory Nevertheless the afd Deft altho’ often required vizt. the tenth day of November in the Year afd at the Parish County and Jurisdiccõn afd and often afterwards the afd Sum of Six hundred pounds of good Sound Marchantable Leafe Tobacco to the afd Plt he hath not rendered nor paid but that to him to render or pay hitherto hath refused and Still doth refuse and unjustly detains to the damage of him the Said Plt twelve pounds Sterling money and thereupon he brings Suite &ca D:Macbride pr Quer Plds Jno Doe & Richd Roe And now at this Court to wit the 15th day of March Anno Domi 1719 The afd Deft persent here in Court comes and defends the force and injury when &ca. and Says that he Cannot gainsay the Plt his accõn afd So as afd agst. him brought nor can he Say but that the Said Plt ought to Recover his debt by Occation of the premises afd with Cost of Suite which the Said Plt does not gainsay Therefore it is Considered by the Justices here the 15th day of March Anno Domi 1719 afd That the Said John Hendrickson Recover against the Said Martin Flanigan as well the Sume of Six hundred pounds of Tobacco his debt afd in forme afd Confessed as also the Sume of Two hundred and Eighty pounds of Tobacco by the Court here adjudged to him for his Costs and Charges about his Suite in this behalfe laid out & expended and the Deft in mercy &ca. month Anno Domi 1719 being the day of return of Said writ Endorst Cepi Corpus pr me Simon Wilmer Sher. And the afd Deft. by Thomas Bowne his attry comes and defends the force and injury &ca. And Saving to himselfe all manner of advantages and Exceptions as well to the writ as to the Decln of the Said Plts prays liberty to imparle thereto and to answer at next Court which he hath the Same day is given the Plts also
