Compa. —— | This being an Accõn of Debt Commenced by the Plt against

             at | the Said Deft wherein the Sherf of Kent County to whom the

Thomas Everit – | writ in the Same accõn was directed on the third tuesday
   in March to wit the 15th day of the Same month Anno Domi 1719 being the
   day of return of Said writ Endorst Cepi Corpus pr Simon Wilmer Sherf.
      Whereupon at the Prayr. of the Plt by his Attry the Deft is adjudged
   to give Special baile to the Accõn afd And that the Sherf of Said County keep
   ye Said Deft in Safe Custody untill he Shall give Special baile as afd
   Kent County | Thomas Evert of Kent County Planter als Dicts Thos Evret of the
           in | Ss   County of Queen Anns in the Province of Maryland Plantr. was Sumd.
      Maryland    | to Answer unto William Hunt and Company of a plea that he


render them the full and Just Sume or Quantity of one thousd two
   hundred and fourty and four pounds of every way Good Sound Mrchtable Cleane
   leafe Tobaco. in good well Seasoned Casque to Containe the Same Convenient
   in ye County afd of the value of twelve pounds eight Shillings and eight
   pence Sterlg money which from them he unjustly detains &ca. and whereupon
   the afd Plts by David Macbride their attry Say that whereas the afd Deft the
   Second day of July in the Year of our Lord Christ one Thousand Seven hundred
   and Nineteen at St. Pauls Parish in Kent County within the Jurisdiccõn of this Court
   by his Certain writing Obligatory which he the Said Deft Sealed with his Seale
   and as his deed delivered hereinto Court brought whose date is the Same day &
   year above mentioned granted himselfe holden and firmly bound unto the
   afd Plts in the afd full and Just Sume or Quantity of one Thousand two —
   hundred and forty and four pounds of Every way good Sound Merchantable
   Cleane leafe Tobacco in good well Seasoned Casque to Containe the Same Convenient
   In ye County afd of the afd value of twelve pounds eight Shillings and eight
   pence Sterlg money to be paid unto the afd Plts. when thereunto required —
   Nevertheless the the afd Deft altho often required the afd full and Just Sume
   or Quantity of one Thousand two hundred and forty and four pounds of every
   way good Sound Merchantable Clean Leafe Tobacco in good well Seasoned Casque
   to Containe the Same Convenient in ye County afd to the Said Plts he hath
   not rendered or paid but that to them to render or pay hitherto hath denyed
   and Still doth deny and unjustly detains to the damage of the Said Plts twelve
   pound eight Shillings and eight pence Sterlg money and thereupon they bring

      and the afd Deft. comes and Defends the force and injury when &ca. and Says
   that he Cannot gainsay the Plt. his Accõn afd So as afd against him brought nor
   can he Say but that the Said Plt ought to Recover his debt by Occation of the
   premises afd and Cost of Suite against him which the Said Plt does not
   gainsay Therefore it is Considered by the Justices here the 15th. day of March
   Anno Domi 1719 That the Said William Hunt and Company Recover against
   the Said Thomas Everitt as well the Sume of one Thousand two hundred
