    368                                  Novembr. Court 1719
   promises & assumptions afd in forme afd made as to the afd Several Sums
   of Tobacco which in the whole amounts unto five Thousand four hundred
   and eighty eight pounds of Merchantable Tobacco he hath not minded
   nor in any ways kept But altho’ he the Said Deft hath paid and Satis:
   :fied unto the afd Plt the Sume of two Thousand and fifty three pounds of
   Tobacco of the afd Sum of five Thousand four hundred and eighty eight
   pounds of Merchantable Tobacco Part Yet the afd Deft his Promises and
   assumptions as to the Sum of Three Thousand four hundred and thirty
   five pounds of Merchantable Tobacco as afd Residue litle regarding
   but plotting and fraudulently Intending him the Said Plt of the afd Sum
   of Three Thousand four hundred and thirty five pounds of Merchantable
   Tobacco Craftily to deceive & defraud the Said Sum of Three Thousand —
   four hundred and thirty five pounds of Merchantable Tobacco the
   Same Deft to him the Said Plt he hath not paid nor in any wise
   made Content for the Same altho’ to do the Same the afd Deft afterwds
   vizt. the tenth day of March in the Year afd at the Parish County & Jurisdiciõn
   afd and often afterwards by the Said Plt. was thereunto required —
   But that to him to pay or Content for the Same he the Said Deft
   hitherto hath refused & Still doth refuse to the damage of him the Said
   Plt Six Thousand eight hundred & Seventy pounds of Merchantable
   Tobacco and thereupon he brings Suite &ca.
