Novembr. Court 1719 367 Indeed Sayth that the afd Goods wares and Merchandizes at the afd time of their Sale and delivery at the Parish County & Jurisdiciõn afd were reasonably worth and Amounted to the Sume of two hundred and Sixty pounds of Merchantable Tobacco in manner as in the Said Account is Sett forth of which the Said Deft then and there last mentioned had Notice And that whereas also the afd Deft after: :wards vizt. the afd last mentioned fifth day of December in the Year afd at the Parish County and Jurisdiciõn afd In Consideration that the afd Plt at the like Special Instance & request of the afd Deft had then and there last — mentioned paid unto a Certain Andrew Petterson and to the use and behoofe of the afd Deft the Sume of one hundred forty and Eight pounds of Merchant: :able Tobacco in an Accot hereunto Annexed Sett forth upon himselfe assumed and to the Said Plt then and there last mentioned faithfully promised that he the Said Deft the afd Last mentioned Sum of one hundred fourty and Eight pounds of Merchantable Tobacco unto the Said Plt when thereto required — would well & truly Pay and Content And that whereas also the afd Deft afterwards vizt the nineth day of February in the Year afd at the Parish County and Jurisdiciõn afd In Consideration that the afd Plt at the like Special Instance and request of the afd Deft had then and there last men: :tioned Sold & delivered unto the afd Deft and to the proper use and — behoofe of the afd Deft diverse other goods wares and Merchandizes at the Severall Rates & prices in an Accot hereunto Annexed Sett forth in the whole amounting to the Sume of Six hundred and thirty Nine pounds of Merchantable Tobacco upon himselfe assumed and to the Said Plt then and there last mentioned faithfully Promised that he the Said Deft the afd last mentioned Summ of Six hundred and thirty Nine pounds of Merchant. :able Tobacco unto the Said Plt when thereunto required would well and truly pay and Content And that Whereas also the afd Deft afterwards viz the afd Nineth day of February in the Year afd at the Parish County and Jurisdiciõn afd In Consideration that the afd Plt at the like Special Instance & request of the afd Deft had Sold & delivered diverse other Goods Wares and Merchandizes and to the Proper use and behoofe of the afd Deft as in an Accot. hereunto Annexed Particularly Sett forth upon himselfe assumed and to the Said Plt then and there last menti: :oned faithfully Promised that he the Said Deft So much Merchantable Tobacco as the Said Goods Wares and Merchandizes last mentioned Sold and delivered as afd at the time of the Sale and delivery of the Same were reasonably worth to the Said Plt when thereunto required would well and truely Pay & Content And the afd Plt Indeed Sayth that the afd last mentioned Goods Wares and Merchandizes at the afd time of their Sale & delivery at the Parish County and Jurisdiction afd at reasonable rates and prices were worth and amounted unto the Sume of Six hundred and thirty nine pounds of Merchantable Tobo. in manner as in the Said Accot is Sett forth of which the Said Deft then & there last mentioned had Notice Nevertheless the afd Deft his Sevll pro: |
